HEALTH FACILITIES PERMITS

Amends the Illinois Health Facilities Planning Act. Sets forth the requirements for the review of a permit application to establish, construct, or modify a health care facility. Provides that the Health Facilities and Services Review Board shall afford an opportunity for a public hearing concerning a permit application. Sets forth the requirements for post-permit reports. Extends the deadline for the Health Facilities and Services Review Board to establish certain rules concerning long-term care to September 30, 2011. Provides that a permit holder who fails to comply with certain post-permit and reporting requirements shall be fined an amount not to exceed $10,000 plus an additional $10,000 for each 30-day period, or fraction thereof, that the violation continues. Makes other changes.

INS CD-TECH

Amends the Illinois Insurance Code. Makes changes to the provision concerning disclosure of limited benefits. Provides that when a beneficiary, insured, or enrollee utilizes a participating network hospital or a participating network ambulatory surgery center and, due to any reason, in network services for radiology, anesthesiology, pathology, emergency physician, or neonatology are unavailable and are provided by a nonparticipating facility-based physician or provider, the insurer or health plan shall ensure that the beneficiary, insured, or enrollee shall incur no greater out-of-pocket costs than the beneficiary, insured, or enrollee would have incurred with a participating physician or provider for covered services. Sets forth provisions concerning written explanation of benefits, billing, assignment, negotiated reimbursement, arbitration, prudent laypersons, failure to make an offer of payment, and noncovered services.

IL S&L & SAVING BANK ACT-FUND

Amends the Illinois Savings and Loan Act of 1985. Permits an association to amend the articles of incorporation for the purpose of changing the name of the association after commencing business if the submission by the board of directors of the association certifies the approval of the proposed name change and has an approved plan for notifying all parties who may be affected by the name change and the new name meets the requirements as determined by the Secretary of Financial and Professional Regulation. Creates the Savings Institutions Regulatory Fund that is to be used for the ordinary and contingent expenses of the Department of Financial and Professional Regulation and the Division of Banking, or their successors. Makes other changes. Amends the Savings Bank Act. Creates a provision for savings bank to, after commencing business, amend the articles of incorporation for the purpose of changing the name of the savings bank if the board of directors of the savings bank approves the name change and a plan for notifying all parties who may be affected by the change and the new name meets the requirements as determined by the Secretary. Provides that any person aggrieved by a decision of the Secretary of Financial and Professional Regulation under the Savings Bank Act may receive a hearing before the Secretary. Creates provisions that outline procedures for an aggrieved person to request a hearing and the procedures for the Secretary or his or her agent to subpoena records, investigate verified complaints, and record the proceedings. Makes other changes. Amends the Division of Banking Act, Electronic Funds Transfer Act, and the Corporate Fiduciary Act to make corresponding changes. Amends the State Finance Act to create the Savings Institution Regulatory Fund.

INS CD-VOLUNTEER DRIVERS

Amends the Illinois Insurance Code. Provides that an insurer may not refuse to issue vehicle insurance to a person solely because the applicant is a volunteer driver and may not impose a surcharge or otherwise increase the rate for a vehicle policy solely on the basis that the named insured or any member of the insured's household or a person who customarily operates the insured's vehicle is a volunteer driver. Provides that the provision concerning volunteer driver protection shall not prohibit an insurer from taking any actions upon factors other than the volunteer status of the insured driver. Effective immediately.

CORRECTIONAL OPERATIONS

Amends the State Finance Act. Creates the Illinois Department of Corrections Parole Division Violent Offender Supervision Fund in the State treasury. Also creates the Illinois Department of Corrections Operations Assistance Fund in the State treasury. Amends the Clerks of Courts Act. Increases the fee that the county board may authorize the circuit clerk to collect for automated record keeping to not less than $10 (rather than $1) and not more than $20 (rather than $15). Provides that the additional fee paid by a defendant in any felony, traffic, misdemeanor, local ordinance, or conservation case upon a judgment of guilty or grant of supervision shall be deposited into the Illinois Department of Corrections Parole Division Violent Offender Supervision Fund rather than the State Police Operations Assistance Fund. Amends the Unified Code of Corrections. Provides that an additional fine of $25 shall be imposed upon a person convicted of any violation of the Criminal Code of 1961 who was at the time of the commission of the offense in violation of parole orders. Provides that $5 of the fine shall be deposited into the Circuit Court Clerk Operation and Administrative Fund created by the Clerk of the Circuit Court to be used to offset the costs incurred by the Circuit Court Clerk in performing the additional duties required to collect and disburse funds as provided by law. Provides that the remainder of each such additional fine shall be remitted by the Circuit Court Clerk within one month after receipt to the State Treasurer for deposit into the Illinois Department of Corrections Parole Division Violent Offender Supervision Fund in the State treasury. Effective immediately.

METRO WATER RECLAMATION DIST

Amends the Metropolitan Water Reclamation District Act. In provisions concerning promotional examinations, authorizes the director of a sanitary district to require candidates to separately pass the efficiency and seniority parts of a promotional examination. Provides that if the director requires candidates to separately pass the efficiency and seniority parts of a promotional examination, then any candidate who does not pass the efficiency and seniority parts of the examination shall fail the entire examination. In provisions concerning certain appointments, adds that the director shall certify the addresses of the candidates from succeeding categories in the order of excellence of the categories only until 5 names are provided to the appointing officer. Effective immediately.

REGISTER TITLES-TORRENS-REPEAL

Amends the Registered Titles (Torrens) Act. Provides that the Act is repealed on January 1, 2014 (rather than July 1, 2037). Effective January 1, 2012.

IL CREDIT UNION-HEARING REQ

Amends the Illinois Credit Union Act. Provides that if a credit union requests a hearing in response to an order of a fine, the Secretary of Financial and Professional Regulation shall schedule a hearing within 30 days after the request and the order shall be stayed until the final administrative order is entered. Makes changes in provisions concerning reciprocity, the powers and duties of the Secretary, powers of a credit union, and vacancies in the board of directors. Makes other changes. Also makes technical changes concerning the capitalization of "articles of incorporation," "board of directors," "credit committee," "chairman," and other terms. Effective January 1, 2012.
