Amends the Property Tax Code. Provides that relief from an order for a tax deed may be had under certain provisions of the Code of Civil Procedure concerning motions after judgment in nonjury cases. Provides that notice of the expiration of the period of redemption must be served upon certain owners and parties interested in the property in the manner set forth under certain provisions of the Code of Civil Procedure (now, personal service). Requires the court to enter orders to place the tax-deed grantee's successor in interest in possession of the property and authorizes the court to grant other relief to maintain the successor in interest in possession. Provides that the notice of the expiration of the period of redemption may not be served more than 6 months (now, 5 months) before the expiration of the period of redemption. Provides that the changes concerning post-judgment motions and the changes concerning the possession by the tax-deed grantee's successor in interest must be construed as being declarative of existing law and not as a new enactment.

Amends the State Finance Act. Excludes moneys received by the Department of Financial and Professional Regulation under the Illinois Credit Union Act from those moneys required to be deposited into the Financial Institution Fund. Makes certain provisions concerning transfers to the General Revenue Fund inapplicable to (i) any fund established under the Illinois Credit Union Act, the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, or the Savings Bank Act and (ii) the Professions Indirect Cost Fund. Limits transfers and expenditures from those funds to specified purposes. Prohibits the allocation or transfer of additional amounts generated by certain fee increases with respect to or from the Credit Union Fund. Amends the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, and the Savings Bank Act. With respect to the moneys in each of the Bank and Trust Company Fund, the Savings and Residential Finance Regulatory Fund, and the Credit Union Fund, (i) exempts those moneys from assignment or transfer except for unappropriated administrative expenses and (ii) provides that the moneys remain the property of and must be held in trust for the financial institutions from which they were collected. For FY08, requires the Commissioner of Banks and Real Estate (now, the Director of the Division of Banks and Real Estate) to adopt rules to adjust regulatory fee rates in the specified manner. Amends the Illinois Credit Union Act. Provides that the regulatory fee paid by a credit union to the Department of Financial and Professional Regulation shall be the lesser of (i) the rate pursuant to the regulatory fee schedule or (ii) a rate established in a manner proportionately consistent with the rates in the regulatory fee schedule and that would fund the actual administrative and operational expenses of the Credit Union Section. Increases rates in the regulatory fee schedule for credit unions with total assets over $5,000,000. Requires the Director of Financial and Professional Regulation to adjust the fee schedule for the next fiscal year. Provides that the fee schedule may be increased by no more than 5% annually if necessary to defray the actual (now, estimated) administrative and operational expenses of the Credit Union Section (now, the Department). Prohibits any increase in the fee schedule if the amount remaining in the Credit Union Fund at the end of the fiscal year is equal to or greater than 25% of the actual administrative and operational expenses for the preceding fiscal year. Requires the Director to base the regulatory fee for the next fiscal year on the credit union's total assets as of December 31 of the preceding calendar year. Beginning on July 1, 2005, requires a credit union to pay the regulatory fee in quarterly installments due and payable on the due date for the call report for the preceding quarter (now, a credit union is required to pay the regulatory fee in full no later than March 1 of each calendar year). Provides for a regulatory fee cap of $125,000 (now, $187,500). Effective immediately.
Creates the Opportunity Scholarship Act and amends the Illinois Income Tax Act. Provides findings and declarations of policy. Establishes the Opportunity Scholarship Program. Provides that under the program the custodian of a qualifying pupil is entitled to a Tutoring Opportunity Scholarship or a School Opportunity Scholarship to pay for qualified education expenses at participating Chicago elementary and secondary schools or tutoring agencies. Requires the principal of each school in the Chicago school district to notify custodians of qualified pupils of the availability of scholarships. Requires custodians to apply to the State Board of Education for a scholarship and provide documentation as to eligibility. Requires the State Board to issue a scholarship to custodians who have made proper application and to honor the scholarship when presented for payment by a school or tutoring agency pursuant to certain procedures. Provides for the dollar amount of a scholarship and provides that the total amount of scholarships paid under the program may not exceed $15,000,000 in a school year. Provides that the scholarship may be renewed each year through the 12th grade so long as the pupil and custodian remain eligible. Requires pupils receiving scholarships to be assessed in the same manner as Illinois public school students. Provides that the amount received under the program shall not be considered base income for purposes of Illinois' income tax. Requires the State Board to submit a report to the General Assembly by December 31, 2010. Provides criminal penalties for certain violations. Requires the State Board to adopt rules to implement the Act.
Amends the Code of Civil Procedure. Provides for the reimbursement of costs and attorney's fees for the defendant in a eminent domain condemnation proceeding. Sets out a rate schedule for attorney's fees based upon the benefit to the defendant and a list of factors that the court shall consider when determining the amount of those fees.
Creates the FY07 Cost of Doing Business Adjustment Act. Provides that the rates in effect for fiscal year 2007 paid by the Department of Children and Family Services to foster parents for the care of abused and neglected children shall include an increase of 3%. Provides that a 3% increase shall be included in all purchase of care contracts and grant agreements paid under specified line items in the fiscal year 2007 State budget for the Department of Human Services and the Department of Children and Family Services. Effective July 1, 2006.
Amends the Illinois Clean Indoor Air Act. Provides that a home rule unit of local government or any municipality in this State may regulate smoking in public places. Provides that this regulation must be no less restrictive than the regulation in the Act. Changes the home rule limitation from an absolute preemption to a limitation on the concurrent exercise of home rule power. Maintains the exemption from home rule requirements for home rule units that passed ordinances regulating smoking before October 1, 1989. Limits the concurrent exercise of home rule powers.
Amends the Chicago Firefighter Article of the Illinois Pension Code. Provides that a fireman who receives a duty disability or occupational disease disability benefit after December 31, 1994 and fails to receive duty availability pay because of that disability may elect to have an amount equal to that missed duty availability pay included in the calculation of his or her salary for retirement and widow's annuity purposes only. Requires payment of the corresponding employee contributions. Allows the election to be made by the fireman's surviving spouse, child, or parent in certain circumstances. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

Amends the Chicago Firefighter Article of the Illinois Pension Code to increase the maximum retirement annuity, duty disability benefit, and duty death benefit from 75% to 80% of salary. Also makes technical changes. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
Creates the Independent Living Projects Act. Requires the Department on Aging and the Department of Human Services to contract with independent living projects in different regions of the State to demonstrate the feasibility and cost-effectiveness of using low-cost home care and other residential alternatives to nursing home care and to achieve other goals. Sets forth criteria that such projects must meet. Requires the Department to establish up to 6 projects to expand the respite care network in the State. Requires the Department to (i) evaluate the independent living projects and report to the General Assembly by February 15, 2008 and (ii) contract for a public awareness campaign. Provides for grants to public and private nonprofit agencies to establish services that strengthen a community's ability to provide a system of home and community-based services for elderly persons.
