Appropriates $17,098,500 from the General Revenue Fund to the Department of Public Health for local health protection grants to certified local health departments for various health protection programs. Effective immediately.
Amends the Eminent Domain Act. Provides that a public university of this State may not acquire property by condemnation or eminent domain if the university's current land holdings are sufficient to accommodate the development of the university's planned improvements. Provides that if an attempt is made to take private property due to the alleged inadequacy of the university's current land holdings, the question whether the current land holdings are truly not adequate shall be a judicial question and determined without regard to any administrative or legislative assertion that the university lacks the land necessary to erect its planned improvements. Provides that a public university of this State may not acquire property by condemnation or eminent domain to advance the economic interest of private parties to be given ownership or use of the property taken. States that the new provisions apply to all condemnations by public universities in this State pending or filed after the effective date of the amendatory Act.
Creates the Home Birth Safety Act. Provides for the licensure of midwives by the Department of Financial and Professional Regulation and for certain limitations on the activities of licensed midwives. Creates the Illinois Midwifery Board. Sets forth provisions concerning qualifications, grounds for disciplinary action, and administrative procedures. Amends the Regulatory Sunset Act to set a repeal date for the new Act of January 1, 2027. Amends the Medical Practice Act of 1987, the Nurse Practice Act, and the Illinois Public Aid Code to make related changes. Effective July 1, 2016.
Amends the Unified Code of Corrections. Repeals provision that committed persons shall be responsible to reimburse the Department of Corrections for the expenses incurred by their incarceration at a rate to be determined by the Department. Amends the Code of Civil Procedure to make conforming changes.
Amends the Mental Health and Developmental Disabilities Administrative Act and the Illinois Public Aid Code. Provides that the Department of Human Services shall establish reimbursement rates which build toward livable wages for front line personnel in residential and day programs serving persons with intellectual and developmental disabilities, including but not limited to intermediate care facilities for persons with developmental disabilities, community integrated living arrangements, developmental training programs, employment, and other residential and day programs for persons with intellectual and developmental disabilities supported by State funds or funding under Title XIX of the federal Social Security Act. Provides that the Department shall increase rates and reimbursements so that direct support persons earn a base wage of not less than $15 per hour and so that other front line personnel earn a commensurate wage. Defines "front line personnel". Effective immediately.
Amends the Temporary Assistance for Needy Families Article of the Illinois Public Aid Code. Provides that the first $100 of child support collected on behalf of a family in a month for one child and the first $200 of child support collected on behalf of a family in a month for 2 or more children shall be passed through to the family and disregarded in determining the amount of the assistance grant provided to the family. Provides that any amount of child support that would be disregarded in determining the amount of the assistance grant shall be disregarded in determining eligibility for cash assistance. Effective immediately.
Amends the Uniform Electronic Legal Material Act. Makes a technical change in a Section concerning the short title.
Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Adds involuntary sexual servitude of a minor to the offenses for which a health care worker license can be revoked. Provides that if a licensed health care worker has been convicted of a forcible felony, other than a forcible felony requiring registration under the Sex Offender Registration Act or involuntary sexual servitude of a minor that is a forcible felony, and the health care worker has had his or her license revoked, the health care worker may petition the Department of Financial and Professional Regulation to restore his or her license. Establishes factors that the Department shall consider in determining whether a license shall be restored. Further provides that this process for petition and review by the Department shall apply to a person whose licensed is denied under these provisions.
Amends the Juvenile Court Act of 1987 and the Code of Criminal Procedure of 1963. Provides that a minor who was under 18 at the time of the commission of an offense must be represented by counsel throughout the entire custodial interrogation. Provides that an oral, written, or sign language statement of a minor made without counsel present throughout the entire custodial interrogation of the minor shall be inadmissible as evidence in any juvenile court proceeding or criminal proceeding against the minor. Provides that in a proceeding under the Criminal Code of 2012, a minor who was under 18 at the time of the commission of the offense must be represented by counsel throughout the entire custodial interrogation of the minor and an oral, written, or sign language statement made without counsel present shall be inadmissible in any criminal proceeding against the minor.
Amends the Park District Code. Requires park districts to determine if an applicant for employment has been convicted of (rather than convicted of or adjudicated a delinquent minor for) specified criminal or drug offenses listed in the Section within 5 years of the application for employment, or convicted of a felony within 2 years (rather than 7 years) of the application for employment. Removes several offenses from the specified criminal or drug offenses listed in the Section. Amends the Chicago Park District Act making the same changes. Effective immediately.
