Amends the Contractor Prompt Payment Act. Provides that under a construction contract, it is unlawful to withhold more than 5% retainage on payments earned by contractors and subcontractors, and that upon completion of 50% of the work under the contract, retainage may not exceed 2.5%. Effective immediately.

Amends the State Finance Act, the Use Tax Act, the Service Use Tax Act, the Retailers' Occupation Tax Act, and the Metropolitan Pier and Exposition Authority Act. Extends the duration and increases the amounts of deposits of certain use and occupation tax proceeds into the McCormick Place Expansion Project Fund. Increases certain bond authorization limits of the Metropolitan Pier and Exposition Authority from $2,107,000,000 to $2,457,000,000 and makes changes to the required maturity dates of the bonds. Makes other changes. Effective immediately.
Creates the Internet Dating Disclosure and Safety Awareness Act. Requires an online dating service provider offering services to residents of this State to disclose clearly and conspicuously, to any member who provides a billing address or a zip code in this State when registering with the provider, that the online dating provider either initiates a background check of felony and sex offense convictions on each member prior to permitting any member to communicate with a member in this State or that the online dating service provider does not initiate such a background check. Provides language concerning the disclosures. Requires an online dating service provider that conducts criminal background checks to post a safety awareness notification and provides required language for that notification. Provides that failure to comply with the disclosure requirements of the Act shall constitute an unlawful business practice under the Consumer Fraud and Deceptive Business Practices Act. Provides that each failure to provide the required disclosure constitutes a separate violation. Provides for civil penalties. Creates the Internet Dating Disclosure and Safety Awareness Act Fund to be used by the Office of the Attorney General for enforcement of the Act. Amends the State Finance Act to create the Internet Dating Disclosure and Safety Awareness Act Fund. Amends the Consumer Fraud and Deceptive Business Practices Act. Adds the Internet Dating Disclosure and Safety Awareness Act to the list of Acts that the knowing violation of which constitutes an unlawful business practice.

Amends the Mercury-added Product Prohibition Act. Provides that no person shall distribute or sell any cosmetics, toiletries, or fragrances containing mercury. Provides that any person who knowingly sells or distributes mercury-containing cosmetics, toiletries, or fragrances in this State commits a petty offense and shall be fined up to $500. Provides that a manufacturer that distributes cosmetics, toiletries, or fragrances containing mercury to persons in this State must disclose the level of mercury in its cosmetics, toiletries, or fragrances. A manufacturer who fails to disclose the level of mercury in its cosmetics, toiletries, or fragrances commits a business offense and shall be fined $10,000. Effective January 1, 2009.
Amends the Shaken Baby Prevention Act. Makes a technical change in a Section concerning the short title.
Amends the Illinois Insurance Code. Requires coverage of treatment for mental, emotional, or nervous disorders or conditions by a licensed marriage and family therapist when the insurance covers mental, emotional, or nervous disorders or conditions. Effective immediately.
Amends the Illinois Library System Act. Increases the amount of certain grants from the State to public and school libraries. Effective immediately.
Changes the composition of the Illinois Family-Law Study Committee.
Amends the Department of Public Health Powers and Duties Law. Creates the Chronic Disease Prevention and Health Promotion Task Force. Provides for membership and appointments. Requires hearings. Provides that on or before July 1, 2010, the Task Force shall, at a minimum, make recommendations to the Governor and the General Assembly on the following: reforming the delivery system for chronic disease prevention and health promotion in Illinois; ensuring adequate funding for infrastructure and delivery of programs; and on the role of health promotion and chronic disease prevention in support of State spending on health care. Contains other provisions. Effective immediately
