DAY LABORERS-DISCRIMINATION

Amends the Day and Temporary Labor Services Act. In the Section containing legislative findings, adds a finding that temporary laborers are vulnerable to discriminatory practices. Defines "day or temporary labor applicant". In a Section concerning recordkeeping, provides that the day and temporary labor service agency shall keep a record of the race, ethnicity, and gender of each day or temporary laborer or day or temporary labor applicant, as provided by the person who requests employment with or is contracted by the day and temporary labor service agency (instead of "the race and gender of each day or temporary laborer sent by the day and temporary labor service agency"). Provides that the day and temporary labor service agency shall provide each day or temporary labor applicant with and retain a copy of a written notice signed by an employee of the day and temporary labor agency and specifying the date, time, and location the applicant requested employment. Provides that at the time of annual registration, the day and temporary labor service agency shall submit to the Department of Labor, on a form created by the Department, a report containing the information required by the new provisions, grouped by branch office, in the aggregate for all day or temporary laborers assigned within this State in the prior year. Provides that in the case of a health and safety or notice violation, a private right of action exists for compensatory damages and an amount between $50 and $500 for each violation (instead of "up to $500 for the violation"). Makes corresponding changes.

DHFS-MCO PERFORMANCE METRICS

Amends the Medical Assistance Article of the Illinois Public Aid Code. In a provision concerning network adequacy for managed care organizations (MCO) contracted with the Department of Healthcare and Family Services, provides that each MCO shall (i) on a monthly basis, jointly validate with contracted providers any changes in provider information, including, but not limited to, changes concerning new providers, terminated providers, updated address information, hours of operation, or other information that is material to a Medicaid beneficiary in the enrollment and provider selection process; and (ii) be required to produce system reports that validate that all MCO systems reflect updated provider information. Provides that in situations in which an enrolled Medicaid provider renders services based on information obtained after verifying a patient's eligibility and coverage plan through either the Department's current enrollment system or the coverage plan identified by the patient presenting for services, such services shall be considered rendered in good faith. Requires the Department to create and maintain a MCO Performance Metrics Comparison Tool that provides periodic reporting, on at least a quarterly basis, of each MCO's performance in various administrative measures. Requires the tool to be accessible in both a print and online format, with the online format allowing for Medicaid beneficiaries and providers to access additional detailed MCO performance information. Effective immediately.

RULES PUBLIC HEARING NOTICE

Amends the Illinois Administrative Procedure Act. Provides that if an agency decides to hold a public hearing, it shall post on its Internet website certain requisite information to provide the public with notice of the proposed rulemaking. Provides that if an agency decides not to initiate a public hearing, it shall post the requirements to request a public hearing, along with information on the proposed rulemaking, on its Internet website.

$DEPT OF INSURANCE-TECH

FOID CARD - REVOCATION

Amends the Illinois Police Training Act. Provides the annual training of police chiefs must include at least one course on the Firearm Owners Identification Card Act, the Firearm Concealed Carry Act, and firearms investigations. Amends the Firearm Owners Identification Card Act. In the definition of "clear and present danger" that the person demonstrates threatening physical or verbal behavior, such as violent, suicidal, or assaultive threats, actions, or other behavior, adds that it includes any act that is intended to cause or create a risk and does cause or create a risk of death or great bodily harm to one or more persons. Permits the Department of State Police to notify the FBI if a person on the Terrorist Watchlist submits an application for a Firearm Owner's Identification Card (FOID card). Requires the Department of State Police to, within 3 business days, provide notice and reason for the disqualification of a person from a firearm purchase or FOID card revocation to all law enforcement agencies with jurisdiction to assist with the seizure of the person's FOID card. Adds as grounds to deny an application for or to revoke or seize the person's FOID card that the person is charged with making a terrorist threat or soliciting or providing material support for terrorism under State law or a similar offense of another state or under federal law. Provides if the Department of State Police has not received the FOID card or Firearms Disposition Record from the person, the Department shall send notice of noncompliance to the sheriff and law enforcement agency where the person resides.

PUB AID-HIV VIRAL LOAD REPORTS

Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that, beginning July 1, 2018, Accountable Care Entities, Managed Care Community Networks, and Managed Care Organizations shall report annually on HIV viral load suppression as a quality measure related to HIV/AIDS disease management. Requires implementation of reporting on the HIV quality measure to be done in consultation with the Department of Healthcare and Family Services, the Department of Public Health, health care providers and community-based organizations with expertise in HIV/AIDS care, impacted MCOs, and other interested parties and to be based on nationally-recognized quality measurement standards.
