Amends the Illinois Identification Card Act and the Illinois Vehicle Code. Provides the Secretary of State may require an applicant to utilize the same residence address and name on a State identification card, driver's license, and instruction permit. Provides that the Secretary of State may allow applicants for a driver's license or State identification cards to provide a mailing address in addition to a residence address. Provides that the Secretary of State may adopt rules regarding the use of foreign language interpreters during the application and examination process. Effective immediately.
Amends the Illinois Equipment Fair Dealership Law. Provides that "outdoor power equipment" includes all-terrain vehicles or off-highway motorcycles for purposes of the definitions of "inventory" and "retailer" and for purposes of provisions concerning repurchase of inventory, supplementation to contract rights, and excluded inventory. Effective immediately.
Amends the Clerks of Courts Act. Provides that each Circuit Court Clerk shall charge and collect an electronic citation fee of $5, which shall be paid by the defendant in any traffic, misdemeanor, municipal ordinance, or conservation case upon a judgment of guilty or grant of supervision. Provides that 60% of the fee shall be deposited into the Circuit Court Clerk Electronic Citation Fund and 40% of the fee shall be disbursed to the arresting agency to defray expenses related to the establishment and maintenance of electronic citations. Contains provisions regarding the administration of and expenditures from the Circuit Court Clerk Electronic Citation Fund. Provides that the Circuit Court Clerk shall not charge and collect an electronic citation fee if the County Board has by ordinance elected not to be subject to the new provisions and provides for the disposition of fees collected before such an ordinance takes effect.
Amends the Illinois Vehicle Code to provide that in certain undue hardship cases where a person's driving privileges have been suspended or revoked, the Secretary of State may issue a restricted driving permit to allow a person to transport children, elderly persons, or disabled persons who do not hold driving privileges and are living in the person's household (rather than just children living in the person's household) to and from daycare. Amends the Unified Code of Corrections. Provides that during a sentencing hearing, the court must make a finding of whether a motor vehicle was used in the commission of the offense for which the defendant is being sentenced. Provides that in cases in which the court finds that a motor vehicle was used in the commission of the offense, the clerk of the court shall, within 5 days thereafter, forward a report of such conviction to the Secretary of State.
Amends the Open Meetings Act. Permits a municipal transit district with jurisdiction over more than 4,500 square miles to include members participating in a video conference at specified locations when determining the physical presence of a quorum at an open meeting. Provides that the requirement that members of a public body with less than statewide jurisdiction be physically present at a closed meeting does not apply to a municipal transit district with jurisdiction over more than 4,500 square miles.
Amends the State Fair Act. Makes a technical change in a Section concerning the short title.
Amends the Illinois Fertilizer Act of 1961. Prohibits any applicator for hire from applying fertilizer material containing phosphorus to any parcel of turfgrass except as demonstrated to be necessary by a soil test conducted no more than 36 months before the intended application by a laboratory already identified and approved by the Department of Agriculture, unless the fertilizer material is a 0% phosphate fertilizer or a person is establishing turfgrass in the first growing season. Restricts the application of fertilizer material on impervious surfaces, near bodies of water, and when the ground is frozen. Enlarges the Department's rulemaking powers under the Act. Exempts the following types of property from the requirements of the Act: property used in the operation of a commercial farm, lands classified as agricultural lands, and golf courses. Authorizes local government code enforcement officers to issue notices of violation. Limits home rule powers. Defines "applicator for hire", "buffer", "frozen ground", "impervious surface", "saturated ground", "soil test", "soil test lab", "spreader", "turfgrass", and "0% phosphate fertilizer". Amends the Clerks of Courts Act. Provides that fines imposed under the Illinois Fertilizer Act of 1961 as a result of the issuance of a notice of violation by a code enforcement officer of a unit of local government shall be returned to the unit of local government that issued the notice of violation, and that the fines imposed under that Act as a result of the issuance of a notice of violation by the Department of Agriculture shall be deposited into the Fertilizer Control Fund. Effective July 1, 2010.
Amends the Alzheimer's Special Care Disclosure Act, the Assisted Living and Shared Housing Act, the Community Living Facilities Licensing Act, the Life Care Facilities Act, and the Nursing Home Care Act. Changes the short title of the Alzheimer's Special Care Disclosure Act to the Alzheimer's Disease and Related Dementias Special Care Disclosure Act. Changes all cross-references to the Act to be consistent with this change. Effective immediately.
