Amends the Nursing Home Care Act. Makes a technical change in a Section concerning the short title.
Amends the School Code. Provides that a non-public elementary or secondary school may not obtain "Non-public School Recognition" status unless (i) the school requires all applicants for employment with the school, after July 1, 2007, to authorize a fingerprint-based criminal history records check as a condition of employment to determine if such applicants have been convicted of specified criminal or drug offenses and (ii) the school performs a check of the Statewide Sex Offender Database for each applicant for employment, after July 1, 2007, to determine whether the applicant has been adjudicated a sex offender. Provides that no non-public school may obtain recognition status that knowingly employs a person, hired after July 1, 2007, for whom a Department of State Police and Federal Bureau of Investigation fingerprint-based criminal history records check and a Statewide Sex Offender Database check has not been initiated or who has been convicted of certain criminal or drug offenses. Contains provisions concerning a fee for the criminal history records check and reimbursement, confidentiality, and checks of employees of persons or firms holding contracts with the school. Effective July 1, 2007.
Amends the Illinois Enterprise Zone Act. Provides that a private development is qualified to become and is an enterprise zone and eligible for all the benefits of an enterprise zone if it (i) achieves certification using nationally recognized and accepted green building and sensible growth guidelines, standards, or systems, and (ii) is selected through a request for proposals by the Capital Development Board. Amends the Capital Development Board Act. Provides that the Capital Development Board shall issue a request for proposals by December 31, 2008 to select 3 model private developments that are designated by specified organizations as achieving certification using nationally recognized and accepted green building and sensible growth guidelines on a neighborhood scale. Provides that the model projects shall be designated as such to receive the benefits attained through Illinois Enterprise Zones for a period of 5 years.
Amends the Illinois Income Tax Act. Deletes the provision that refunds with respect to the earned income tax credit are subject to the availability of funds from the federal Temporary Assistance for Needy Families Block Grant and the State's ability to meet its required Maintenance of Effort. Effective immediately.
Amends the Illinois Vehicle Code, School Code, Child Passenger Protection Act, and Unified Code of Corrections. Makes various changes regarding: driver education requirements; graduated driver's licenses; instruction permits for minors; curfews for drivers under a specified age; the number of passengers under a specified age allowed in a vehicle driven by a newly licensed driver under a certain age; the use of seat safety belts; the use of wireless telephones by graduated driver's license holders; suspensions of driver's licenses of drivers under age 21 under specified circumstances; required appearances before the presiding judge with a parent or guardian under specified circumstances; vehicle impoundment for drivers arrested for street racing; and other matters. Repeals provisions creating the offense of drag racing. Creates the offenses of street racing and aggravated street racing, and makes conforming changes. Makes other changes. Effective January 1, 2008, except that the provisions amending the School Code are effective July 1, 2008.
Amends the Wildlife Code. Provides that a person may not operate, provide, sell, use, or offer to operate, provide, sell, or use any computer software or service that allows a person not physically present at the hunt site to remotely control a weapon that could be used to take wildlife by remote operation, including, but not limited to, weapons or devices set up to fire through the use of the Internet or through a remote control device. Provides that a violation is a Class B misdemeanor. Provides that a person who facilitates the use of software or services to hunt by remote control is guilty of a Class A misdemeanor. Effective immediately.
Amends the Property Tax Code. Authorizes, except in Cook County, the personal service of the notice of the expiration of the period of redemption to be made by licensed or registered private detectives. Provides that the amount of redemption includes the costs incurred in causing notices to be served by a licensed or registered private detective, but those costs may not exceed the amount that the sheriff would be authorized by law to charge if those notices had been served by the sheriff.
Amends the Department of Natural Resources (Conservation) Law of the Civil Administrative Code of Illinois to provide that a local bank account established for the World Shooting and Recreational Complex that is used to hold income received before and during a competitive shooting event, to pay out cash prizes for the same event for which the income was received, or to purchase prizes for that event is exempt from a requirement that the balance of the account be forwarded to the Department for deposit with the State Treasurer on Monday of each week if the amount exceeds $500. Requires such an account to be in the name of the Department and subject to regular audits. Limits the balance of the account to a maximum of $250,000. Effective immediately.
Creates the Illinois Radon Awareness Act. Provides definitions, including "residential real property" which means a manufactured housing lot or a parcel of real property, improved with not less than one nor more than 4 residential dwelling units. Provides that the Act applies to the sale of any interest in residential real property by an owner or through a real estate broker. Provides that the seller shall provide a prospective buyer with a pamphlet entitled "Radon Testing Guidelines for Real Estate Transactions", prepared by the Illinois Emergency Management Agency. Provides that buyer has the right to have the property inspected for radon. Provides that the buyer and seller, and any brokers involved, must sign a statement acknowledging that the buyer was notified of his or her rights under the Act and received the information required by the Act. Provides that a seller is not required to have the property tested for radon, but must furnish the buyer with a copy of any radon tests conducted on the property. Provides that the Act does not apply to transfers: pursuant to court order; from a mortgagor to a mortgagee in lieu of foreclosure; by a fiduciary; from a co-owner to another co-owner; through testate or intestate succession; to a spouse or a relative in the lineal line of consanguinity; that are part of a seller's relocation; or, to or from a governmental entity. Effective immediately.
