Amends the Illinois Controlled Substances Act. Creates the offense of criminal synthetic drug manufacturing conspiracy, defined as aiding in the manufacture or production of a synthetic controlled substance with the intent that a controlled substance be manufactured or produced in violation of the Act. Provides that an act in furtherance to aid in the manufacture or production must be proved to have been committed by the defendant or a co-conspirator. Provides that a person convicted of criminal synthetic drug manufacturing conspiracy may be fined or imprisoned or both, but any term of imprisonment imposed may not be less than the minimum nor more than the maximum provided for the offense that is the object of the conspiracy. Effective immediately.

Amends the Drug Paraphernalia Control Act. Defines drug paraphernalia as equipment, products, and materials of any kind which are intended to be used unlawfully (rather than peculiar to and marketed for use) in violation of the Cannabis Control Act or the Illinois Controlled Substances Act. Makes conforming changes in other Sections of the Act. Effective immediately.
Amends the State Finance Act. Provides that, on March 31, 2003 or as soon as practicable thereafter, the amount of $300,000 shall be transferred from the Statistical Services Revolving Fund to the Illinois Military Family Relief Fund. Provides that, beginning on July 1, 2004, on the last day of each month, an amount equal to 50% of that day's beginning balance in the Illinois Military Family Relief Fund shall be transferred from the Illinois Military Family Relief Fund to the Statistical Services Revolving Fund. Provides that these transfers shall continue until the cumulative total of transfers executed from the Illinois Military Family Relief Fund to the Statistical Services Revolving Fund equals $300,000. Effective immediately.
Amends the Illinois Insurance Code. Increases the penalties for unreasonable and vexatious delay. Provides that arbitration with respect to claims under uninsured motorists coverage is binding in all cases. Authorizes a cause of action by persons who are damaged by improper claims practices. Requires the Department of Insurance to publish and make available to the general public information it obtains relating to consumer complaints.
Amends the Condominium Property Act and the General Not For Profit Corporation Act of 1986. Provides that a condominium association, master association, common interest community association, or homeowners' association may not prohibit the display of the American flag or the installation of a flagpole for the display of the American flag, subject to specified conditions.
Amends the Public Funds Investment Act and the Investment of Municipal Funds Act. Provides that a county, park district, sanitary district, or other municipal corporation may, by resolution or by ordinance (now, by ordinance only) use money in specified funds to purchase bonds and other interest bearing obligations of states other than the State of Illinois or of any political subdivision or agency of the State of Illinois or of any other state, whether the interest earned thereon is taxable or tax-exempt under federal law (now, the funds can only be used to purchase only certain municipal bonds or bonds and other interest bearing obligations of the United States and the State of Illinois). Effective immediately.
Amends the Criminal Code of 1961. Creates the offense of drug related child endangerment. Provides the a person commits the offense of drug related child endangerment when he or she endangers the life and health of a child by knowingly exposing the child to a clandestine drug laboratory environment. Provides that the penalty is a Class 2 felony. Creates the offense of aggravated drug related child endangerment. Provides that a person commits the offense of aggravated drug related child endangerment when he or she: (1) commits a violation of drug related child endangerment, and (2) the child experiences death, great bodily harm, disability or disfigurement as a result of the drug related child endangerment. Provides that the penalty is a Class X felony. Effective immediately.
Amends the Funeral Directors and Embalmers Licensing Code. Changes the term "funeral director and embalmer trainee" to "funeral director and embalmer intern" and makes conforming changes throughout the Code. Corrects references to the Federal Trade Commission Funeral Rule. Removes outdated provisions. Removes courses offered by the Illinois Selected Morticians Association, Inc., the National Foundation of Funeral Service, and the National Selected Morticians from and adds courses offered by Selected Independent Funeral Homes to the list of courses that shall be accepted toward satisfaction of continuing education requirements. Makes changes in provisions concerning reciprocity and disciplinary grounds. Makes regular inspections of funeral establishments by the Department and taking disciplinary actions against the licensee discretionary rather than mandatory. Provides that branch operations of main businesses having a preparation room and located in the State of Illinois are exempt from the requirement that each fixed place of practice or establishment maintain a preparation room. Repeals provisions concerning the transition to the current Code. Makes other changes.
Amends the Criminal Code of 1961. Creates the offense of endangering the life and health of an emergency service provider. Provides that it is a Class X felony if an emergency service provider experiences death, great bodily harm, disability, or disfigurement as a result of entering a structure containing a clandestine drug laboratory designed or intended to produce an unlawful controlled substance or designed or intended to produce ingredients used in the manufacture of an unlawful controlled substance. Effective immediately.
Amends the Department of Public Health Act. Makes technical changes in a Section concerning the powers of the Department.
