INSUR-GASTROINTESTINAL TRTMT

Amends the Illinois Insurance Code, the Health Maintenance Organization Act, the Limited Health Service Organization Act, and the Voluntary Health Services Plans Act. Requires accident and health insurance policies to include coverage for nonprescription enteral formulas and reduced-protein foods that are necessary for the treatment or management of certain gastrointestinal conditions or inherited diseases involving amino acids. Effective immediately.

NURSES-LOAN REPAY ASSIST

Creates the Loan Repayment Assistance for Nurses Act. Requires the Department of Public Health to establish an educational loan repayment assistance program for nurses who practice in Illinois in Designated Shortage Areas. Provides that beginning July 1, 2007, the Department shall consider applications for assistance under the program. Sets forth eligibility requirements for applicants. Provides that for each year that a qualified applicant practices full-time as a nurse in a Designated Shortage Area, the Department shall, subject to appropriation, award a grant to that person in an amount equal to 5% of the total amount in educational loans that the person must repay. Provides that the total amount in grants that a person may be awarded shall not exceed $25,000. Provides that loan payment recipients who fail to practice full-time in Illinois in Designated Shortage Areas for 5 years shall repay the Department a sum equal to 3 times the amount received under the program.

FINANCIAL INSTITUTIONS-FEES

Amends the State Finance Act. Excludes moneys received by the Department of Financial and Professional Regulation under the Illinois Credit Union Act from those moneys required to be deposited into the Financial Institution Fund. Makes certain provisions concerning transfers to the General Revenue Fund inapplicable to (i) any fund established under the Illinois Credit Union Act, the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, or the Savings Bank Act and (ii) the Professions Indirect Cost Fund. Limits transfers and expenditures from those funds to specified purposes. Prohibits the allocation or transfer of additional amounts generated by certain fee increases with respect to or from the Credit Union Fund. Amends the Illinois Banking Act, the Illinois Savings and Loan Act of 1985, and the Savings Bank Act. With respect to the moneys in each of the Bank and Trust Company Fund, the Savings and Residential Finance Regulatory Fund, and the Credit Union Fund, (i) exempts those moneys from assignment or transfer except for unappropriated administrative expenses and (ii) provides that the moneys remain the property of and must be held in trust for the financial institutions from which they were collected. For FY08, requires the Commissioner of Banks and Real Estate (now, the Director of the Division of Banks and Real Estate) to adopt rules to adjust regulatory fee rates in the specified manner. Amends the Illinois Credit Union Act. Provides that the regulatory fee paid by a credit union to the Department of Financial and Professional Regulation shall be the lesser of (i) the rate pursuant to the regulatory fee schedule or (ii) a rate established in a manner proportionately consistent with the rates in the regulatory fee schedule and that would fund the actual administrative and operational expenses of the Credit Union Section. Increases rates in the regulatory fee schedule for credit unions with total assets over $5,000,000. Requires the Director of Financial and Professional Regulation to adjust the fee schedule for the next fiscal year. Provides that the fee schedule may be increased by no more than 5% annually if necessary to defray the actual (now, estimated) administrative and operational expenses of the Credit Union Section (now, the Department). Prohibits any increase in the fee schedule if the amount remaining in the Credit Union Fund at the end of the fiscal year is equal to or greater than 25% of the actual administrative and operational expenses for the preceding fiscal year. Requires the Director to base the regulatory fee for the next fiscal year on the credit union's total assets as of December 31 of the preceding calendar year. Beginning on July 1, 2005, requires a credit union to pay the regulatory fee in quarterly installments due and payable on the due date for the call report for the preceding quarter (now, a credit union is required to pay the regulatory fee in full no later than March 1 of each calendar year). Provides for a regulatory fee cap of $125,000 (now, $187,500). Effective immediately.

INC TAX-RECYCLING SERVICES

Amends the Illinois Income Tax Act. Provides for an income tax credit for landlords who provide recycling services to their residential tenants. Provides that credit does not apply with respect to any property that is located within a unit of local government that provides recycling services to its residents. Provides that the credit may not be carried forward or back and may not reduce the taxpayer's income to less than zero.

MEDICAID-NURSING HOME RATES

Amends the Illinois Public Aid Code. In provisions concerning Medicaid rates for nursing homes, provides that for facilities licensed by the Department of Public Health under the Nursing Home Care Act as Intermediate Care Facilities for the Developmentally Disabled or Long Term Care for Under Age 22 facilities, the rates taking effect on July 1, 2006 shall include an increase of 6.25% on State funding, to achieve a full 5% increase in the facilities' topline rates. Effective immediately.

INS-AUTO INS CANCELLATION

Amends the Illinois Insurance Code. Requires insurers issuing policies of automobile insurance to report to the Secretary of State when insureds cancel their automobile insurance policies or do not renew their automobile insurance policies. Amends the Illinois Vehicle Code. Requires the Secretary of State to maintain a database of drivers' automobile insurance coverage and track any lapses in coverage or cancellations. Provides that the Secretary of State may suspend the motor vehicle registration of any person found to have a history of purchasing insurance and cancelling or not renewing it and not obtaining automobile insurance with another insurer.

CTY CD-PUBLISH ASSESSMENTS

Amends the Counties Code. Provides that the Committee of Local Improvements may provide notice of a special assessment over the internet. Provides that, if the Committee does not publish notice in the newspaper, it is required to provide notice over the internet. Effective immediately.

DOMESTIC VIOLENCE

Amends the Juvenile Court Act of 1987 and the Adoption Act. Provides for the termination of parent rights for the commission of various acts against children. Amends the Criminal Code of 1961 and the Unified Code of Corrections. Reenacts various criminal provisions of P.A. 89-203 that were held unconstitutional by the Illinois Supreme Court in People v. Wooters as violating the single subject clause of the Illinois Constitution. Amends the Criminal Code of 1961, the Harassing and Obscene Communications Act, and the Code of Criminal Procedure of 1963. Changes the elements of the offenses of domestic battery, violation of an order of protection, and harassing and obscene communications. Makes other changes.

ECON DEV CREDIT-QUALIFICATION

Amends the Economic Development for a Growing Economy Tax Credit Act. Provides that an Applicant may qualify for tax credits if the Applicant has 100 or fewer employees and is located or will locate in a county for which the annual unemployment rate was at least 1% higher than the average annual statewide unemployment rate during the most recent year for which those statistics are available from the Department of Employment Security, the project will involve an investment of at least $500,000 in capital improvements to be placed in service, and the project will employ at least 2 New Employees within the State as a direct result of the project. Effective immediately.

RURAL TECHNLGY DEVELOPMNT ZONE

Creates the Rural Technology Development Zone Act. Allows the Department of Commerce and Economic Opportunity to designate 3 rural areas in the State as rural technology development zones. Provides that the Department of Commerce and Economic Opportunity shall submit a report to the General Assembly outlining the progress in improving wireless telecommunications and Internet access within rural technology development zones. Amends the Illinois Income Tax Act to provide a tax credit for investments in technology infrastructure required to provide wireless telecommunications and Internet access in rural technology development zones. Effective immediately.
