Amends the State Budget Law of the Civil Administrative Code of Illinois. Expands current continuing appropriations provisions to cover executive branch operations and all State universities (currently, the provisions cover only judges and the legislative branch). Defines "executive branch operations" to include all State agencies, the office of any constitutional officer, including any agency or entity reporting to a constitutional officer, and any agency, board, commission, or other entity of the executive branch. Effective immediately.
Amends the Illinois Public Aid Code. In provisions concerning the child care assistance program, requires the Department of Healthcare and Family Services to furnish child support enforcement services in behalf of persons who are applicants for or recipients of child care benefits in accordance with the requirements of Title IV, Part D of the Social Security Act. Provides that a parent or other person having custody of a child receiving child care benefits must comply with any rules adopted by the Department regarding enforcement of a child support obligation. Requires the Department of Human Services to, by rule, establish a system of sanctions for persons who fail to cooperate, without good cause, with the child support programs provided under the Code or Title IV of the federal Social Security Act. Makes changes concerning the child support enforcement services provided by the Department. Provides that, by accepting financial aid under the child care assistance program, a spouse or a parent or other person having custody of a child is deemed to have made assignment to the Department of any and all rights, title, and interest in any support obligation, including statutory interest thereon, up to the amount of financial aid provided. Makes other changes concerning notification of support obligation, support payments, and judicial enforcement of the support liability. Effective immediately.
Amends the Unified Code of Corrections. Provides that the court shall impose an extended term sentence when a defendant is convicted of first degree murder, second degree murder, or involuntary manslaughter in which the victim of any of these offenses was a person under 18 years of age and the death of the victim resulted from child abuse. Provides that before the imposition of an extended term sentence, the State's Attorney shall present evidence to the court at the sentencing hearing of the defendant describing the facts in the case. Provides that if the court finds that the death of the person under 18 years of age was the result of child abuse, the court shall impose an extended term sentence upon the defendant. Provides that if the court does not make the finding, the court shall impose any other sentence for the offense as prescribed in the Code. Defines "abuse".
Creates the Continuing Appropriation for School Transportation Act to require a General Revenue Fund recommendation by the Governor in the annual budget and annual General Revenue Fund appropriations by the General Assembly sufficient to fund certain transportation reimbursement claims of school districts and to require a continuing appropriation if the General Assembly fails to make sufficient General Revenue Fund appropriations. Amends the Block Grants for Chicago Article of the School Code. Removes regular and vocational transportation from the list of programs that the educational services block grant must include. Effective immediately.
Amends the Public Assistance Fraud Article of the Illinois Public Aid Code. Increases the criminal and civil penalties for medical assistance fraud committed by individuals and corporations.
Amends the Firearm Owners Identification Card Act. Eliminates provision that each applicant for a Firearm Owner's Identification Card who is over the age of 18, other than a person employed as a law enforcement officer, an armed security officer in Illinois, or by the United States Military permanently assigned in Illinois and who is not an Illinois resident, shall furnish to the Department of State Police either his or her Illinois driver's license number or Illinois Identification Card number.
Amends the Illinois Public Aid Code. Provides that on and after January 1, 2017, electronic benefits transfer ("LINK") cards used to obtain Supplemental Nutrition Assistance Program (SNAP) benefits or cash shall contain the name and photo of the primary cardholder and, at the option of the primary cardholder, the names of secondary holders who are authorized to use the card. Establishes that an individual may only use the LINK card if the photo on the card matches the user or he or she presents a current and valid photo identification that confirms that he or she is a secondary user listed on the card. Provides that on the effective date of the amendatory Act the Department of Human Services shall begin the process of transitioning to the use of LINK cards which contain the name and photo of the primary cardholder and list the names of all authorized users of the card. Requires the transition to be completed no later than January 1, 2017. Effective immediately.
Amends the Illinois Public Aid Code. Provides that subject to federal approval, applicants for or recipients of benefits under the federal Supplemental Nutrition Assistance Program (SNAP) or the State's medical assistance program shall prepare and submit a personal plan for achieving employment and self-sufficiency at the time of application or redetermination of eligibility for such benefits. Provides that in order to receive SNAP benefits or benefits under the State's medical assistance program, a single parent who heads an assistance unit and who is able to work shall be required to work or participate in a work activity for at least 30 hours per week; 2 parents who head an assistance unit shall be required to work a combined 35 hours per week. Requires the Department of Human Services and the Department of Healthcare and Family Services to seek any necessary waiver from the federal government in order to implement these provisions.
Amends the Election Code. Provides that each local election authority shall, within 2 weeks of election day, deliver to the State Board of Elections a list of all voters that requested vote by mail ballots and either voted early or was given a provisional ballot at their precinct on election day. Provides that the State Board of Elections, in consultation with the State's Attorney with jurisdiction over the election authority, shall review the lists and investigate to determine whether any voter's intent when voting early or requesting such provisional ballots on election day was to vote more than once. Provides that, if such investigation reveals that the voter knowingly attempted to vote more than once, he or she shall be guilty of a Class 3 felony.
