CRIMINAL LAW-TECH

Amends the Unified Code of Corrections. Makes a technical change in a Section of the sentencing Chapter of the Code concerning the definition of "victim".

ST ETHICS-GA FAMILY NEPOTISM

Amends the State Officials and Employees Ethics Act. Makes it a Class A misdemeanor for a State executive branch constitutional officer, General Assembly member, or State employee (including an appointee) to knowingly employ or seek to influence the employment or promotion of a relative of a General Assembly member in a position as a State employee.

ELECTIONS-ROBO CALLS

Amends the Election Code. Provides that an automatically generated telephone communication that (i) is directed at voters and (ii) mentions the name of a candidate at the next election or advocates for or against a public policy position must identify the person or entity paying for the communication. Makes knowing generation of a violating communication a Class A misdemeanor.

DOC-EMPLOYEE TERMINATIONS 2009

Creates the Department of Corrections Employees Termination Act of 2009. Provides for the termination of certain designated employees, by operation of law, who occupy a exempt position within the Department of Corrections, excluding the Director of the Department of Corrections. Allows the Governor to make temporary appointments and to subsequently nominate or employ a terminated person. Effective immediately.

SECURITIES LAW-VIOLATION-FINE

Amends the Illinois Securities Law of 1953. Provides that the Secretary of State may impose a fine not to exceed $100,000 (instead of not to exceed $10,000) for a violation of the Law. Provides that in addition to any other sanction or remedy provided for, the Secretary of State, after finding that any provision of the Law has been violated, shall notify all of the clients of any sanctioned party, by registered mail, that a violation has taken place. Provides that the costs of this notification shall be covered by fines imposed on the sanctioned party. Provides for immunity from liability for the Secretary of State. Effective immediately.

REAL ESTATE DISCLOSURE-ANNEX

Amends the Residential Real Property Disclosure Act. Adds, to the residential real property disclosure report form, a disclosure of whether the seller is aware of a petition, agreement, or similar document relating to the annexation of the property.

ALL KIDS - RESIDENT

Amends the Covering ALL KIDS Health Insurance Act. Changes the definition of resident to mean a person who meets the residency requirements as defined in the provision concerning residence of the Illinois Public Aid Code (instead of an individual (i) who is in the State for other than a temporary or transitory purpose during the taxable year or (ii) who is domiciled in the State but is absent from the State for a temporary or transitory purpose during the taxable year).

MUNI CD-ANNEXATION

Amends the Illinois Municipal Code. Provides that if a municipality annexes territory, then the municipality must provide no later than one year after the date of annexation basic services to the residents of the annexed territory. Provides that basic services include water, sanitary sewers, police protection, and fire protection. Effective immediately.

DRUG ABUSE-ELECTION-PUBLIC AID

Amends the Election Code and the Illinois Public Aid Code. Requires substance abuse testing as a condition for filing nomination papers for the office of State Representative or State Senator. Requires the Department of Human Services and the Department of Healthcare and Family Services to implement random substance abuse testing programs for applicants for assistance under the Temporary Assistance for Needy Families (TANF) program and for medical assistance, respectively. Under the Illinois Public Aid Code, provides that an individual who tests positive must agree to and complete a substance abuse treatment plan within 60 days after being notified of the positive retest by the Department of Human Services or the Department of Healthcare and Family Services. Provides that if an individual fails to complete a substance abuse treatment plan or tests positive for substance abuse following completion of a substance abuse treatment plan, the individual is barred from eligibility for assistance for a period of one year following the date of the individual's application for assistance. Provides that an individual's ineligibility for assistance does not affect the eligibility of any other member of the individual's family who is included in the application for assistance. Provides that nursing home residents are exempt from the substance abuse testing requirement. Effective January 1, 2010.

IDNR-PROPERTY-MAINTENANCE

Amends the Illinois Public Labor Relations Act. Provides that neither the Act nor any collective bargaining agreement negotiated under the Act may be construed to limit the ability of the Department of Natural Resources to use members of its Volunteer Network to maintain, during budgetary emergencies, State parks and other properties owned or managed by the Department. Amends the Department of Natural Resources (Conservation) Law of the Civil Administrative Code of Illinois and the State Parks Act. Provides that the Department may, during budgetary emergencies, use volunteer labor to maintain State parks and other properties owned or managed by the Department. Provides that "to maintain" includes the mowing of State parks and other properties owned or managed by the Department. Effective immediately.
