Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Provides that the Department of Public Health has the power to make matching grants from the Heartsaver AED Fund to (i) any school, college, or university (instead of any public school, college, or university); (ii) any public park district; or (iii) any municipal recreation department, to assist in the purchase of an Automated External Defibrillator. Removes the requirement that the entity be "required to have" an AED to be eligible for the grant. Provides that any entity applying for a grant shall not receive more than one grant from the Heartsaver AED Fund each fiscal year (instead of per facility). Makes other changes. Effective immediately.

Amends the Physical Fitness Facility Medical Emergency Preparedness Act. Requires that outdoor (as well as indoor) physical fitness facilities have at least one automated external defibrillator (AED) on the premises. Provides that every privately owned or operated outdoor physical fitness facility must be in compliance on or before July 1, 2009. Provides that a public entity owning or operating 4 or fewer outdoor physical fitness facilities must have at least one such facility in compliance on or before July 1, 2009; its second facility in compliance by July 1, 2010; its third facility in compliance by July 1, 2011; and its fourth facility in compliance by July 1, 2012. Provides that a public entity owning or operating more than 4 outdoor physical fitness facilities must have 25% of those facilities in compliance by July 1, 2009; 50% of those facilities in compliance by July 1, 2010; 75% of those facilities in compliance by July 1, 2011; and 100% of those facilities in compliance by July 1, 2012.
Amends the Mortgage Certificate of Release Act. Provides that, if any title insurance company or its duly appointed title insurance agent, knowing the mortgage to be paid pursuant to the lender's written payoff statement, fails to file a certificate of release within one month after the payment of the debt secured by the mortgage or trust deed, the title company shall be liable for and pay to the party aggrieved the sum of $200, for each offense, which may be recovered by the party aggrieved in a civil action together with reasonable attorney's fees. Provides that, in any such action, introduction of a loan payment book or receipt that indicates that the obligation has been paid shall be sufficient evidence to raise a presumption that the obligation has been paid. Provides that, upon a finding for the party aggrieved, the court shall order the title insurance company or its duly appointed title insurance agent, to make, execute, and deliver the certificate of release that complies with the requirements of this Act.
Amends the Regulatory Sunset Act to change the repeal date of the Clinical Social Work and Social Work Practice Act from January 1, 2008 to January 1, 2018. Amends the Clinical Social Work and Social Work Practice Act. Replaces "Department of Professional Regulation" with "Department of Financial and Professional Regulation" and "Director of the Department of Professional Regulation" with "Secretary of Financial and Professional Regulation" throughout the Act. Adds a provision concerning an applicant's or licensee's change of address. Provides that a civil penalty of $10,000 (rather than $5,000) shall be imposed upon an individual for each offense of unlicensed practice. Makes changes to provisions concerning licensure, licensure by endorsement, grounds for disciplinary action, rehearing, and the appointment of a hearing officer. Makes other changes. Effective immediately.
Amends the School Code. Provides that a vision examination must be included as a part of the health examination required within one year prior to entering kindergarten or the first grade, whichever grade the child first enters, of any public, private, or parochial elementary school. Makes related changes. Amends the State Mandates Act to require implementation without reimbursement. Effective January 1, 2008.
Amends the Illinois Procurement Code. Permits a State agency to renew or extend a lease of real property or capital improvements without using the request for information selection process if it is in the State's best interest and the Procurement Policy Board does not object (now, permitted only for renewal or extension of leases in effect before July 1, 2002). Effective July 1, 2007.
Amends the Illinois Public Aid Code. Under the Medicaid program, authorizes the Department of Healthcare and Family Services to provide for the services of persons licensed as a clinical social worker in supplying medical assistance. Prohibits the Department's rules from requiring that services for a specific Medicaid recipient provided by a licensed clinical social worker be recommended by a physician. Effective immediately.
Creates the Diabetes Initiative Act. Provides that the Department of Human Services shall develop a strategic plan to slow the rate of diabetes as a result of obesity and other environmental factors by the year 2010. Provides certain guidelines for the development of the plan. Provides that the Department shall deliver the plan to the Governor and to the General Assembly on or before December 31, 2008. Provides that the Act is repealed on January 1, 2010. Effective immediately.
