Education

Amends the School Code. In a provision concerning twice-exceptional children, changes references from "children" to "students" and defines "twice-exceptional student". Provides that in the development of an individualized education program (IEP) or federal Section 504 plan for a twice-exceptional student, if the student's ability or achievement indicates that the student would benefit from advanced academic programs, then those abilities or achievement levels shall be recognized and addressed in the student's IEP or Section 504 plan and be reflected in the individualized services, goals, accommodations, and objectives for the student, while continuing to provide appropriate services and support for the student's disabilities in all educational settings. Sets forth what the services, goals, objectives, accommodations, and best practices for identifying and addressing the educational and related needs of a twice-exceptional student may include. Effective immediately.

Amends the Courses of Study Article of the School Code. Provides that, as a prerequisite to receiving a high school diploma, each pupil entering the 9th grade beginning with the 2028-2029 school year must successfully complete either 2 years of foreign language courses or at least 2 years of career-focused coursework that has been authorized by the State Board of Education as meeting the requirements for a College and Career Pathway Endorsement under the Postsecondary and Workforce Readiness Act (rather than requiring the successful completion of 2 years of foreign language courses). Amends various Acts relating to the governance of public universities in Illinois. Provides that a public university may not require State public high school graduates, as a condition of acceptance, to have completed any years of foreign language courses unless the university permits, as an alternative to completion of a foreign language course, attainment of a College and Career Pathway Endorsement under the Postsecondary and Workforce Readiness Act. Effective immediately.

Amends the School Code. Provides that a truant minor may not be administratively withdrawn (rather than expelled) for nonattendance unless he or she has accrued 15 consecutive days of absences without valid cause and the student cannot be located by the school district or the school district has located the student but cannot, after exhausting all available supportive services, compel the student to return to school. Requires a school district to make at least 3 documented attempts to notify the parent or guardian of its intent to administratively withdraw a student prior to withdrawing the student. Effective immediately.

Amends the Student Transfer Achievement Reform Act. Provides that the Board of Higher Education and the Illinois Community College Board shall develop a policy to foster the reverse transfer of credit for any student who has accumulated at least 30 (rather than 15) hours of academic credit at a community college and a sufficient number of hours of academic credit at a State university in the prescribed courses necessary to meet a community college's requirements to be awarded an associate degree. Provides that each State university shall automatically notify any transfer student accepted to the State university with at least 30 hours of academic credit at a community college of the option for the reverse transfer of credit within the student's first term of enrollment. Provides that a community college shall provide notification to a student wishing to reverse transfer earned academic credit with instructions on application for conferral of an associate degree. Provides that a community college or State university may not charge an application, transfer evaluation, or graduation fee or any other fee associated with conferral of an associate degree through reverse transfer. Provides that a community college shall include each student awarded an associate degree through reverse transfer within its student information system. Effective immediately.

Creates the Language Equality Acquisition for the Deaf, Hard of Hearing, and Deaf-Blind Children Act. Provides that the State Board of Education, in cooperation with the Deaf and Hard of Hearing Commission and the Department of Human Services, shall establish a language assessment program for deaf, hard of hearing, and deaf-blind children, and select language developmental milestones. Sets forth provisions concerning the scope and purpose of the program and the development of a resource for use by parents and guardians. Provides that the State Board, in cooperation with the Deaf and Hard of Hearing Commission and the Department of Human Services, shall select tools or assessments for educators that can be used to assess the language and literacy development of all deaf, hard of hearing, and deaf-blind children. Sets forth provisions concerning the tools or assessments. Provides that beginning on July 1, 2026, a language assessment shall be given to each child who is deaf, hard of hearing, or deaf-blind and who is less than 6 years of age. Sets forth provisions concerning the assessment. Provides that an advisory committee on language assessment programs shall be established by the State Board, the Deaf and Hard of Hearing Commission, and the Department of Human Services. Sets forth the membership and duties of the advisory committee. Provides that on or before July 1, 2026, the State Board, the Deaf and Hard of Hearing Commission, and the Department of Human Services shall publish a joint action plan and may propose legislation and rules necessary to implement the recommendations of the advisory committee. Sets forth provisions concerning reporting and rulemaking. Effective immediately.

Amends the Educator Licensure Article of the School Code. Allows the State Superintendent of Education to issue a short-term approval for a paraprofessional educator to an individual who does not meet the requirements necessary for issuance of an Educator License with Stipulations with a paraprofessional educator endorsement. Provides that the short-term approval authorizes an individual to serve as a paraprofessional educator in a school district, including a charter school, or a State-operated program, with the short-term approval expiring on June 30 immediately following the third full fiscal year after the approval was issued without renewal. Provides that upon expiration of the short-term approval, the State Superintendent of Education shall issue an Educator License with Stipulations with a paraprofessional educator endorsement to the individual if the individual meets specified requirements.

Amends the Courses of Study Article of the School Code. Provides that the school board of a school district that maintains any of grades 9 through 12 is authorized to adopt a policy under which a student enrolled in grade 7 or 8 who is enrolled in the unit school district or would be enrolled in the high school district upon completion of elementary school may enroll in a required high school course, provided that the course is offered by the high school that the student would attend and the student participates in the course where the student attends school as long as the course is taught by a teacher who holds a professional educator license and endorsed for the grade level and content area of the course (instead of just as long as the course is taught by a teacher who holds a professional educator license and endorsed for the grade level and content area of the course).

Amends the School Code. Provides that if the provider of the micro-credential or digital badge determines and can demonstrate that a student meets all of the criteria required to earn State Global Scholar Certification, then the school district or nonpublic school shall designate that the student has earned State Global Scholar Certification on the student's diploma and transcript.

Creates the Servicemember Education Rights Veneration Act. Requires institutions of higher education (institution) to accommodate service member student's academic military leave and grant prompt readmission when the service member student has not exceeded a cumulative academic military leave period beyond 5 years, provides advance notice of academic military leave to the institution, and provides notice of intent to return to the institution. Requires the institution to readmit a service member student on academic military leave into the next class, classes, or academic year division following the receipt of the notice of intent to return in accordance with the terms of the accommodation. Contains provisions on exemptions to readmission and related reporting requirements on service member students; investigations by the Attorney General's appointed ISERRA Advocate on whether a readmission exemption exists; and other matters. Requires service member students to provide advance notice of pending military service and prohibits institutions from imposing conditions for academic military leave not otherwise imposed under the Act. Contains provisions on military accommodation; academic obligations of service member students; reimbursement for school expenses; academic withdrawal due to military service; rejection of accommodation and the institution's burden of proof; a 5-year military service limitation; records documentation; advance notice requirements on service member students; notice of intent to return; anti-discrimination protections; academic leave for the spouses of servicemembers; Attorney General enforcement authority; remedies; rulemaking authority; and other matters.

Amends the Illinois Speech-Language Pathology and Audiology Practice Act. Allows a speech-language pathologist to diagnose autism spectrum disorders if: (1) the child is under 3 years of age; and (2) the speech-language pathologist is trained in autism diagnostic evaluation methods as part of the curriculum of an approved program, through worksite training, or through continuing education. Provides that if a diagnosis requires a plan of care that includes elements that are outside the scope of practice of a speech-language pathologist, the speech-language pathologist must refer the patient to the appropriate medical personnel for further evaluation or management. Makes conforming changes in the Medical Assistance Article of the Illinois Public Aid Code, and provisions of the Illinois Insurance Code concerning autism spectrum disorders. Effective July 1, 2027.
