Amends the Children with Disabilities Article of the School Code. Provides that, with respect to any State statute or administrative rule that defines a general education classroom to be composed of a certain percentage of students with individualized education programs, such percentage shall exclude students with individualized education programs receiving only speech-language pathology services outside of the general education classroom for a mild speech disorder, provided that the instruction the students receive in the general education classroom does not require modification or accommodation (rather than providing that students with individualized education programs shall exclude students receiving only speech services outside of the general education classroom, provided that the instruction the students receive in the general education classroom does not require modification). Provides that such percentage shall include students with individualized education programs receiving only speech-language pathology services outside of the general education classroom for a moderate to severe speech disorder.
Creates the Reproductive Health Records Privacy Act. Requires health information exchanges to implement policies and technical capabilities by July 1, 2027, to segregate medical information related to abortion care, restrict access by out-of-state entities, and limit disclosure. Provides enforcement through private actions and civil actions by the Attorney General, including injunctive relief and civil penalties. Defines terms. Amends the Medical Patient Rights Act to clarify patient privacy rights and allow segregation of abortion-related information in health information exchanges. Provides for severability.
Amends the Officers and Employees Article of the Counties Code. Allows a public defender who is representing a client in a criminal case to also represent the client in a statutory summary suspension proceeding under a specified provision in the Illinois Vehicle Code arising from the same arrest.
Amends the Code of Criminal Procedure of 1963. Deletes provision that there is a rebuttable presumption that the testimony of a victim who is a child under 13 years of age shall testify outside the courtroom and the child's testimony shall be shown in the courtroom by means of a closed circuit television. Deletes that the presumption may be overcome if the defendant can prove by clear and convincing evidence that the child victim will not suffer severe emotional distress. Provides that if the court denies the State's request for the child victim's testimony to be taken outside of the courtroom, the court shall toll the speedy trial requirements under the speedy trial provisions of the Code for 30 days to allow the State to present the motion to the court again before trial requesting the child's testimony to be taken outside the courtroom by means of a closed-circuit television.
Creates the Faith-Based Housing and Mixed-Use By-Right Act. Provides that a unit of local government shall permit multifamily developments and mixed-use developments as allowable by-right uses on faith-based land. Provides that a unit of local government may not require a proposed multifamily or mixed-use development on faith-based land to obtain any discretionary approval in order to permit the proposed use and development or allow for the minimum development standards and limitations established by the Act. Provides that the by-right entitlement under the Act applies whether or not the faith-based organization continues to operate an existing religious, educational, or community facility on the same parcel or adjacent parcel, and regardless of whether the housing is owned, leased, operated, or developed by the faith-based organization or by a partner acting under agreement with the faith-based organization. Provides that nothing in the Act affects the authority of a unit of local government to apply to a development authorized by this Act requirements that are (1) generally applicable to comparable developments within the jurisdiction; (2) objective and ascertainable on the face of the ordinance or code provision; and (3) related to public health and safety. Provides that a unit of local government shall approve an application for a multifamily or mixed-use development on faith-based land if the development satisfies the unit of local government's generally applicable, objective land development and building regulations as limited by the Act. Limits the concurrent use of home rule powers. Effective immediately.
Amends the Counties Code. Provides that the owner of a commercial wind energy facility or commercial solar energy facility must compensate landowners in full if the facility adversely affects the flow of water within the landowner's land, land adjoining landowner's land, or drainage district land, including, but not limited to, by affecting a drainage tile. Provides that the compensation shall be determined by the Department of Agriculture.
Amends the Network Adequacy and Transparency Act. Replaces provisions concerning uniform electronic provider directory information forms. Provides that each provider shall notify all contracted health insurance issuers of any change to the provider's information. Provides that the health insurance issuer shall use the information to update its provider directory within the time frames required under the Act. Provides that nothing in the provisions shall prohibit a health insurance issuer from using its own process, platform, or electronic system to receive provider directory updates, so long as the system allows providers to submit the required information. Effective immediately.
Amends the Trademark Registration and Protection Act. Provides that any mark and its registration under this Act may be voluntarily cancelled. Repeals provisions concerning infringement of Olympic marks. Amends the Business Corporation Act of 1983. Makes changes in provisions concerning definitions; procedures for revocation of authority; activities that do not constitute transacting business; and annual reports. Amends the General Not For Profit Corporation Act of 1986. Inserts provisions concerning reports of interim changes. Makes changes in provisions concerning the withdrawal of foreign corporations. Amends the Limited Liability Company Act. Inserts provisions concerning the production of abstracts of records; reinstatement following expiration; and grounds for judicial dissolution. Makes changes in provisions concerning company names; assumed names; articles of amendment; statements of termination; grounds for administrative dissolution; revocation; withdrawal; transactions of business without admission; and annual reports. Amends the Uniform Partnership Act (1997). Makes changes in provisions concerning fees. Amends the Uniform Limited Partnership Act (2001). Inserts provisions concerning reinstatement following duration expiration. Makes changes in provisions concerning definitions; assumed names; and amendments or restatements of certification.
Amends the Automatic Contract Renewal Act. Provides that any person, firm, partnership, association, or corporation that sells or offers to sell any products or services to a consumer pursuant to a contract, where such contract automatically renews, shall provide the consumer with the option to cancel the contract, at any time, using a simple cancellation mechanism in the same medium that the consumer used to consent to the contract. Provides that an entity shall provide a clear and conspicuous notice, in a manner that may be retained by the consumer, of any material change to the terms of a contract containing an automatic renewal offer at least 3 days prior to the change to the terms. Sets forth additional requirements concerning the cancellation of automatic renewal offers, continuous service offers, and free trial or promotional period offers entered into online, including requiring an entity to provide a one-step online cancellation link. Makes other changes.
Amends the Illinois Health Care Facilities Planning Act. Repeals the January 1, 2027 inoperative date affecting a change of ownership among related persons. Amends the Illinois Antitrust Act. Repeals the January 1, 2027 inoperative date affecting notice provisions to the Attorney General before a health care merger or affiliation. Amends provisions requiring health care entities to notify the Attorney General within 30 days before a merger or affiliation to include a "covered transaction" even if the parties to the transaction are not themselves a health care facility or provider organization but own or control, directly or indirectly, one or more of the 2 or more health care facilities or provider organizations that will be under common ownership or contracting affiliation if the transaction is consummated, including if parties to the covered transaction are private equity companies. Defines "private equity company" to mean any company or partnership that collects capital investments from individuals or entities and purchases, as a parent company, at any level of corporate ownership, or through another entity or entities so that the company completely or partially owns or controls, a direct or indirect ownership share of an Illinois health care entity or an out-of-state health care entity that generates $10,000,000 or more in annual revenue from patients residing in this State. Creates the Statewide Hate Crime Information Act. Provides that the Illinois State Police shall compile and maintain information about hate crime and shall adopt a uniform reporting format for the entry of pertinent intelligence information regarding the report of a hate crime to the Illinois State Police Statewide Terrorism and Intelligence Center. Provides that each law enforcement agency shall: (1) submit a report to the Illinois State Police through the Central Repository after any arrest with probable cause demonstrating the commission of a hate crime; (2) submit reports of persons arrested for hate crimes as soon as the minimum level of data or information specified by the Illinois State Police is available; and (3) notify the applicable prosecutor of any other information in the accused person's history of perpetrating hate crimes. Amends the Code of Criminal Procedure of 1963. Provides that in a criminal prosecution in which the defendant is charged with a hate crime, evidence of the defendant's commission of another hate crime is admissible and may be considered for its bearing on any matter to which it is relevant.
Amends the Illinois Enterprise Zone Act. In provisions concerning High Impact Businesses, adds utility-scale brownfield site photovoltaic projects and over 5,000 kilowatts and utility-scale solar projects to High Impact Businesses that may be located, at the time of designation, in an enterprise zone. Amends the Illinois Power Agency Act. Provides that "brownfield site photovoltaic project" includes photovoltaics that are interconnected to an electric utility, a municipal utility, a public utility, or an electric cooperative, where at least 50% of the acreage occupied by the photovoltaics is located on the property regulated under specified United States Environmental Protection Agency or Illinois Environmental Protection Agency programs.
