Creates the Peoria Regional Port District Act. Contains only a short title provision.
Amends the State Finance Act. Requires appropriations for higher education to be by separate line items and not by lump sum. Defines terms. Effective immediately.
Amends the Illinois Public Aid Code. In provisions concerning appeals by applicants or recipients of General Assistance, provides that in an appeal in Cook County involving a local governmental unit whose supervisor of general assistance is a member of the Cook County Townships Public Aid Committee, the Committee shall select another township supervisor to serve as an alternate member for that appeal. Provides that the members of each Public Aid Committee and the members of the Cook County Townships Public Aid Committee are immune from personal liability in connection with their service on the committee to the same extent as an elected or appointed judge in this State is immune from personal liability in connection with the performance of his or her duties as judge. Effective immediately.
Amends the Illinois Insurance Code. Prohibits an applicant for a policy of automobile insurance from providing a false address. Provides that a violation is a business offense punishable by a fine of not less than $1,000 and not more than $1,200.
Amends the Funeral Directors and Embalmers Licensing Code. Changes the term "funeral director and embalmer trainee" to "funeral director and embalmer intern" and makes conforming changes throughout the Code. Corrects references to the Federal Trade Commission Funeral Rule. Removes outdated provisions. Removes courses offered by the Illinois Selected Morticians Association, Inc., the National Foundation of Funeral Service, and the National Selected Morticians from and adds courses offered by Selected Independent Funeral Homes to the list of courses that shall be accepted toward satisfaction of continuing education requirements. Makes changes in provisions concerning reciprocity and disciplinary grounds. Makes regular inspections of funeral establishments by the Department and taking disciplinary actions against the licensee discretionary rather than mandatory. Provides that branch operations of main businesses having a preparation room and located in the State of Illinois are exempt from the requirement that each fixed place of practice or establishment maintain a preparation room. Repeals provisions concerning the transition to the current Code. Makes other changes.
Amends the Official Bond Payment Act. Provides that a municipality may obtain, from a risk management pool of municipalities, any official bonds required by law to be furnished by officers of the municipality. Effective January 1, 2004.
Amends the Illinois Act on Aging. Changes the name of the sub-State long term care ombudsman program to the "regional long term care ombudsman program". Provides that the Office of the State Long Term Care Ombudsman rather than the Department on Aging designates and oversees regional long term care ombudsman programs. Includes supportive living facilities within the duties of the Office of the State Long Term Care Ombudsman. Makes other changes. Effective immediately.
Amends the Deposit of State Moneys Act and the Public Funds Investment Act. Provides that if a depositary is subject to the Community Reinvestment Act of 1977, the depositary must have a rating of satisfactory or better in order to be eligible for the deposit of State moneys or public funds. Requires the State Treasurer to review complaints alleging violation of fair lending standards. Provides for the State Treasurer to remove from the list of depositaries those depositaries the State Treasurer finds to have committed violations of fair lending standards.
Amends the Unified Code of Corrections. Makes a technical change in a Section concerning the organization of the Department of Corrections.
Amends the Illinois Insurance Code. Makes technical changes in a Section concerning the short title.
Creates the Credit Card and Debit Card Account Disclosure Act. Provides that a person or entity that provides anything of value upon presentation of a credit card or debit card may not print or otherwise reproduce on the cardholder's receipt either of the following: any part of the credit card or debit card account number, other than the last 5 digits or characters, or the expiration date of the credit card or debit card. Provides that the prohibition does not apply where the person to whom the credit card or debit card is presented cannot record credit card or debit card numbers except in writing or by imprint. Provides that the prohibition does not apply to electronic benefits transfers under the federal Food Stamp Program. Provides that a person who violates the prohibition is liable to the issuer or the cardholder for any actual damages resulting from the use of the cardholder's credit card or debit card without his or her permission and for costs and attorney's fees. Provides that the Act becomes operative on January 1, 2005 with respect to any credit card or debit card transaction receipt device that is in use prior to January 1, 2004, and becomes operative on January 1, 2004 with respect to any such device first put to use on or after January 1, 2004.
Amends the Civil Administrative Code of Illinois. Makes a technical change in a Section concerning the short title of the Code.
