Amends the environmental impact statement law to delete reference to discretionary permits in allowing infrastructure improvements within a highway or public right-of-way to be exempt from environmental assessment requirements. Takes effect 7/1/2050. (SD1)
Creates a separate offense for those who provide anything of value to engage in sexual conduct with another; adds sex trafficking to offenses that can be prosecuted at any time; makes a person strictly liable for sex trafficking of a minor in terms of the victim's age; changes the name of the crime of solicitation of a minor for prostitution to commercial sexual exploitation of a minor while closing loopholes in the law that allow offenders to escape liability, and increases the grade of offense to a class B felony; adds "anything of value" to reflect the reality of non-monetary compensation used in commercial sexual exploitation.
Improves and enhances the ability to have Hawaii National Guard personnel who can serve on active duty in the service of the State without financial hardship through modifications and additions to chapter 121, Hawaii Revised Statutes by authorizing the Hawaii National Guard to add the payment of Tricare Reserve Select or other government funded premium payments to the authorized service member who are not otherwise covered by the State or federally funded medical insurance.
Authorizes the Board of Land and Natural Resources to extend leases of public lands for commercial, industrial, or resort use upon approval of a proposed development agreement to make substantial improvements to the existing improvements. Repeals on June 30, 2026.
Amends Section 353-6.2, Section 353-10, and Section 804-7.1, Hawaii Revised Statutes, enacted as part of Act 179, Session Laws of Hawaii 2019, to delete the additional duties and responsibilities of the Intake Service Centers (ISC), Department of Public Safety, in providing augmented bail reports under the Act's bail reform initiatives, due to the imposition of budget restrictions for the fiscal biennium 2021-23 that defunded the ISC positions responsible for this work.
Provide a framework that supports consistent land use planning and development across the University of Hawaii System and allows project partnerships with qualified persons.
Requires the Hawaii housing finance and development corporation to award funds no later than an unspecified number of days after the deadline to file a consolidated application or no later than an unspecified number of days after the filing of a duly submitted consolidated application if no deadline has been established by the corporation.
Amends part VII of chapter 353, Hawaii Revised Statutes, to establish the SAVIN coordinator position, to be responsible for managing the operations of the SAVIN system.
Makes unlawful the sale of flavored products for electronic smoking devices, mislabeling of e-liquid products containing nicotine, and sale of tobacco products other than through retail sales via in-person exchange. Establishes penalties. Includes e-liquid and electronic smoking devices in the definition of "tobacco products" for purposes of the cigarette tax and tobacco tax law. Increases the license fee for wholesalers and dealers of tobacco products and retail tobacco permit fee. Requires retailers to pay an additional excise tax on the retail price of electronic smoking devices on and after 7/1/2021. Directs a certain percentage of moneys received from the cigarette tax and tobacco tax to the Hawaii tobacco prevention and control trust fund to establish and fund a comprehensive youth tobacco cessation program. Requires a person under twenty-one years of age who unlawfully purchases or possesses tobacco products, including electronic smoking devices, to complete a tobacco education or use cessation program or perform community service for a first offense. Repeals the electronic smoking device retailer registration unit. Repeals provisions relating to delivery of sales under the cigarette tax and tobacco tax law.
