Reclassifies drug paraphernalia possession and delivery offenses from felonies to violations subject to a fine of no more than $500. (HB1501 CD1)
Continues the Hospital Sustainability Program for two years. Increases the cap on the inpatient and outpatient hospital sustainability fees to not more than three and one-half percent of the hospital's net inpatient and outpatient service revenue, respectively. Appropriates $70,000,000 out of the Hospital Sustainability Program Special Fund for Fiscal Years 2017-2018 and 2018-2019. (HB89 CD1)
Requires the Department of Public Safety, in collaboration with various agencies and upon request of the inmates, to issue civil identification cards to inmates and to assist inmates in obtaining the inmates' birth certificate, social security card, and other relevant identification necessary for successful reentry into society. Requires the Department of Public Safety to initiate the process of assisting inmates released to work furlough, extended furlough, or community placement programs at least ninety days prior to the inmates' release. Adds additional qualifying medical conditions for medical marijuana patients and permits possession of additional plants. Amends requirements for and access to testing. Extends deadlines related to implementation of the dispensary system. Amends security, information tracking, and access requirements for licensed facilities. Clarifies DOH regulatory authority. Appropriates funds for the planning and design of a memorial to honor service members of the recent conflicts in the Persian Gulf, Iraq, Afghanistan, and the various theaters of the Global War on Terrorism, to be located at the Hawaii State Veterans Cemetery in Kaneohe, on the island of Oahu, and replicas of the memorial to be located at state veterans cemeteries statewide. Part I: changes the name of the board of dental examiners to the board of dentistry and dental hygiene; beginning on 7/1/2018, changes the board composition by increasing dental hygienist representation and ensuring Oahu and neighbor island representation among dental hygienist members. Part II: clarifies the allowable and prohibited practices requirements for dental assistants; clarifies that rules shall not infringe upon, overlap with, or conflict with the duties and scope of practice for licensed professionals; and prohibits persons from employing, directing, or ordering a dental assistant or other person to perform services or procedures within the scope of practice of dental hygiene. Allows transient accommodations brokers to register as a tax collection agent on behalf of all of its operators and plan managers. Requires registered transient accommodations broker tax collection agent's operators and plan managers to obtain a GET license and TAT registration. Requires registered transient accommodations broker tax collection agents to file periodic and annual GET and TAT returns. Requires that each periodic return be accompanied by an electronic cover sheet containing required information. Requires all registered transient accommodations broker tax collection agents to inquire with their operators and plan managers whether the transient accommodation is in compliance with all pertinent state and county land use and tax laws. Requires the operator or plan manager to provide verification of and a statement confirming compliance with state and county land use laws in the form of a written certification, verification, or permit, as applicable, issued by the appropriate county agency. Allocates an unspecified per cent of GET and TAT taxes to the counties contingent upon establishment of a process to provide verification of compliance by an operator or plan manager with county land use laws. Applies to taxable years beginning after December 31, 2017. Effective date 5/22/2050. (SD2)
