RELATING TO CESSPOOLS.

Requires the Department of Health to hire a third-party consultant to conduct a study on the upgrade, conversion, or connection of cesspools statewide, including financing issues and financing mechanisms. Establishes a working group. Requires a report to the Legislature. Appropriates funds.

RELATING TO AID IN DYING.

Allows a terminally ill adult with the capacity to make an informed healthcare decision to request a prescription for aid in dying medication from their attending physician to facilitate a peaceful death. Ensures that physicians who assist patients in obtaining aid in dying medication are not subject to civil or criminal liability.

RELATING TO FAMILY COURT.

Requires certain persons to immediately report a potential tort claim to the family court when that person has reason to believe that a child in foster custody has suffered an injury that may arise to a tort claim. Establishes procedures for the family court to allow a child in foster custody who has suffered an injury to seek outside legal representation for a claim of damages as a result of a tort. RELATING TO LIQUOR COMMISSIONS.

Requires members of the county liquor commissions and liquor control adjudication boards to submit to annual criminal history record checks. Requires attorneys hired by the liquor commission or liquor control adjudication board to submit to annual criminal background checks. Removes the requirement that the liquor commission appoints and removes an administrator subject to the civil service laws. Makes final decisions by the liquor commission reviewable under chapter 91, Hawaii Revised Statutes.

RELATING TO COASTAL HIGHWAYS.

Requires the Department of Transportation to work in conjunction with the Department of Land and Natural Resources, the School of Ocean and Earth Science and Technology of the University of Hawaii, the county of Maui and federal agencies to develop a strategic plan to protect coastal highways from the effects of coastal erosion and update the plan as needed every five years. Requires a report to the legislature. Appropriates funds.

RELATING TO THE INSTITUTE FOR ASTRONOMY.

Transfers administrative authority, personnel, and facilities for the University of Hawaii Institute for Astronomy currently located at the University of Hawaii at Manoa to the University of Hawaii at Hilo.

RELATING TO CHILD SUPPORT ORDERS.

Allows the child support enforcement agency, at the request of a noncustodial parent or on its own initiative, to require a custodial parent to provide evidence that child support funds are being spent in compliance with an order of support. Allows a noncustodial parent to petition the family court for modification of a child support order if the custodial parent does not provide the requested evidence. Requires the child support enforcement agency to hold the portion of disputed child support funds in trust pending the final disposition of the petition.

RELATING TO EMERGENCIES.

Prohibits places of public accommodation from denying shelter to any person when the State, or any portion thereof, is the subject of an emergency alert that advises the public to immediately seek shelter. Provides for an unspecified civil penalty for each violation. Provides immunity from civil liability, with certain exceptions.
