Sen. Angus McKelvey

Establishes a process for landowners whose real property is at risk of reasonably foreseeable flooding or whose real property has experienced a flood due to man-made alterations or natural conditions on state lands to petition the department of land and natural resources for a flood mitigation action plan. Authorizes landowners to undertake improvements to the state lands if substantial progress is not made within a certain amount of time.

Requires members of the charter school commission to collectively possess strong experience and expertise in various fields. Allows the authorizer's staff to provide technical support up until the completed charter application is submitted. Clarifies charter application notice requirements. Clarifies authorizer compliance requirements in cases of an appeal. Effective 7/1/2050. (HD2)

Requires accredited and non-accredited for-profit post-secondary educational institutions that are authorized to award degrees and operate in the State to disclose on the institution's official website, promotional digital and print media, and contracts for instruction, that they are for-profit businesses. Effective 7/1/2060. (SD1)

Establishes a preference under the procurement code for employers who pledge to hire individuals with disabilities when contracting for goods, services, or construction through competitive sealed bidding, competitive sealed proposals, or both.

Prohibits the eviction of any tenant of Kawaihapai Airfield from being evicted from the airfield until the expiration of the department of transportation and the U.S. Department of the Army's lease, so long as the tenant remains in good standing. Requires the department of transportation to cooperate with any private entity performing an economic feasibility study of Kawaihapai Airfield.

Establishes the office of public-private partnership and the position of state public-private partnership coordinator. Adds design-build-finance-maintain, design-build-operate-maintain, and design-build-finance-operate-maintain project delivery methods to the state procurement code and related conditions and requirements. Appropriates funds. Effective 7/1/2112. (HD1)

Sets the employer contribution rate for small business employers for calendar years 2021 and 2022 at an unspecified schedule. Defines "small business employer". Applies retroactively to 01/01/21.

Allows a bidder of a public works construction project to clarify and correct certain information regarding subcontractors for up to two hours after bid closing. Mandates a two hour waiting period after bid closing before construction bids can be opened. Prohibits bid shopping and bid peddling for the competitive sealed bidding process. Requires public procurement construction bids to list subcontractors and joint contractors only for contracts with an unspecified total value; provided that bids lacking this list may be accepted if in the State's best interest and the value of the work to be performed by the joint contractor or subcontractor is equal to or less than an unspecified percent of the total bid amount. Repeals 7/1/2023.

Establishes the Lipoa point special management area and a visitor fee to be used for the management and maintenance of the Lipoa point special management area and to educate visitors of the stewardship activities being funded by the visitor fees. Creates the Lipoa point special management area special fund. Requires reports to the legislature.

Requires that Hawaii housing finance and development corporation housing projects, in a county having a population of more than 100,000 but less than 1,000,000, include a restrictive covenant that the percentage of units of the housing project that are designated as affordable housing, as described in the submitted housing project application, shall be affordable housing in perpetuity.
