Sen. Lorraine R. Inouye

Requires the department of land and natural resources to develop an intake and dispatch training program to enable the department to efficiently and effectively receive and respond to information and reports relating to conservation and resource enforcement matters received on the division of conservation and resource enforcement's direct line. Appropriates funds to the department of land and natural resources to establish one full-time equivalent (1.0 FTE) permanent civil service position to provide intake and dispatcher services for the division of conservation and resource enforcement.

Repeals the provision of the Uniform Information Practices Act that prohibits the disclosure of certain information regarding misconduct by a county police department officer if the misconduct only resulted in the suspension of the officer.

Expands the authorized uses of funds collected from school impact fees to include spending on new school facilities, purchase of completed construction for school use, and improvement of existing school structures.

Bans knowingly selling in the State personal care products containing oxybenzone or octinoxate, except for medically-licensed prescriptions. Takes effect on 10/1/2017.

Requires by the end of the 2017-2018 school year, that all public schools, public charter schools, and the University of Hawaii and its divisions, campuses, and institutions have automated external defibrillators situated in a permanent location on campus. Requires the University of Hawaii and public and charter schools that have an athletic trainer to have an automated external defibrillator available at each sporting event. Requires the automated external defibrillators to be maintained and tested regularly. Clarifies that an athletic trainer or faculty member who administers an automated external defibrillator shall be considered to be doing so without remuneration or expectation of remuneration for purposes of immunity from civil liability.

Requires boundary amendments reflected in certain county plans to be approved by a county land use decision-making authority, with concurrence but without further action of the Land Use Commission. For all areas of planned growth subject to such boundary amendments, requires agencies responsible for providing public infrastructure to prepare budgets that prioritize funding for public infrastructure in those areas of planned growth.

Creates the Hawaii Working Family Tax Credit, a refundable credit capped at 10 percent of the federal earned income tax credit.

Requires that all mandatory fees charged by a transient accommodation operator to a guest or resort time share vacation plan manager to an occupant be included in the gross rental or gross rental proceeds for purposes of the transient accommodations tax. Requires operators and plan managers to identify optional fees that are not subject to the transient accommodations tax to guests and occupants when rental rates and services are disclosed or discussed.

Specifies that 0.5 per cent of the gross proceeds of a county's surcharge on state tax shall be used to reimburse the State for costs associated with handling the assessment, collection, and disposition of the county surcharge on state tax and 9.5 per cent of the gross proceeds shall be used for improvements to infrastructure, street, and trails and bike paths along the rail corridor.

Prohibits the sale, offering for sale, or distribution of any sunscreen containing oxybenzone in the State, unless the sunscreen label contains a warning that the use of oxybenzone in nearshore waters poses serious hazards to coral and reef health.
