Allows the Department of Hawaiian Home Lands to retain independent legal counsel as needed. Authorizes the Department of Hawaiian Home Lands to use the services of the Attorney General as needed and when the interests of the State and the Department of Hawaiian Home Lands are aligned. Provides that funds owed to independent legal counsel shall be paid by the State.

Includes e-liquid and electronic smoking devices within the definition of "tobacco products", as used in the cigarette tax and tobacco tax law. Establishes a tax of twenty per cent for the wholesale price for electronic smoking devices and 10 cents for each milliliter of e-liquid. Allocates a portion of funds collected on excise taxes on electronic smoking devices and eliquids to the trauma system special fund, community health centers special fund, and emergency medical services special fund.
Makes unlawful the sale of flavored products for electronic smoking devices, mislabeling of e-liquid products containing nicotine, and sale of tobacco products other than through retail sales via in-person exchange. Establishes penalties. Includes e-liquid and electronic smoking devices in the definition of "tobacco products" for purposes of the cigarette tax and tobacco tax law. Increases the license fee for wholesalers and dealers of tobacco products and retail tobacco permit fee. Requires retailers to pay an additional excise tax on the retail price of electronic smoking devices on and after 7/1/2021. Directs a certain percentage of moneys received from the cigarette tax and tobacco tax to the Hawaii tobacco prevention and control trust fund to establish and fund a comprehensive youth tobacco cessation program. Requires a person under twenty-one years of age who unlawfully purchases or possesses tobacco products, including electronic smoking devices, to complete a tobacco education or use cessation program or perform community service for a first offense. Repeals the electronic smoking device retailer registration unit. Repeals provisions relating to delivery of sales under the cigarette tax and tobacco tax law.
Repeals the Aha Moku Advisory Committee on July 1, 2021. Effective 6/30/2021.
Establishes the state payor committee within the department of health to: (1) establish uniform baseline performance metrics and evaluation standards for procurement contracts for services relating to behavioral health, substance abuse, and homelessness services; (2) establish uniform reimbursement rates for such contracts; and (3) review and recommend approval for such contracts. Requires that such contracts be reviewed by the Committee prior to approval, initiation, continuation, or renewal beginning 7/1/21. Requires nongovernmental entities that contract for services relating to behavioral health, substance abuse, or homelessness services to disclose any sources of funding to perform such services.
Authorizes licensed physician assistants and advanced practice registered nurses to perform certain abortions.
Authorizes the governor to ensure the continued operation of medical facilities during times of health or pandemic emergencies. Authorizes hospitals to suspend elective surgeries in order to address bed capacity during the period of emergency.
Exempts members of a county council from the limitation on the number of members that may attend an informational meeting or presentation on matters relating to official board business, including a meeting of another entity, legislative hearing, convention, seminar, or community meeting. Clarifies that such meetings shall be meetings that are open to the public for purposes of permitted interactions. (SD1)

Limits first offense violations of a governor's emergency proclamation requiring persons traveling from out of state to quarantine to a fine of not more than $500, except for those violators who post media of themselves violating the governor's order on social media or who travel to the State with symptoms or a positive test result for COVID-19.
Requires that in evaluating and determining the award for redevelopment of state or county lands through competitive sealed bidding or competitive sealed proposals, the number of housing units proposed shall constitute forty per cent of the evaluation score regardless of whether the development of housing is proposed. Applies to the urban areas of state or county land located within a one-half mile radius of a mass transit station.
