RELATING TO TELECOMMUNICATIONS FACILITIES.

Allows the Department of Transportation to: (1) Install and lease telecommunication facilities; (2) Contract for the installation, lease, and management of telecommunication facilities; and (3) Grant longitudinal access to the right-of-way of a highway for the installation, operation, and maintenance of a telecommunication facility under certain conditions. Requires the Director of Transportation to adopt certain administrative rules. Authorizes the Director of Transportation to offer a broadband service provider use of and access to its spare conduits and related telecommunication facilities under certain conditions. Grants a property owner the right of just compensation from the Department of Transportation or the broadband provider for any decrease in land value due to the expanded use of an existing easement to install or operate a telecommunication facility. Creates the Smart Highway Corridor Special Fund. Exempts the Department of Transportation from rulemaking requirements for one year for the purposes of this Act. Effective 1/1/2050. (SD1)

RELATING TO THE DEPARTMENT OF HEALTH.

Extends the deadline by which the transfer of the Oahu regional health care system from the Hawaii Health Systems Corporation to the Department of Health shall take place. Sets the manner by which the Oahu Regional Health Care System should request operational funding during the transitional period. Exempts the working group from chapter 92, Hawaii Revised Statutes. Appropriates moneys. Effective 1/1/2050. (SD1)

RELATING TO UNDERGROUND STORAGE TANKS.

Requires applications for underground storage tank permits to be accompanied by plans, specifications, and other necessary information. Removes automatic grant of permits for underground storage tanks. Requires the Director of Health to modify, suspend, or revoke a permit if there is a violation of the permit, the permit was obtained by misrepresentation, or if there was a release of regulated substances. Effective 1/1/2050. (SD1)

RELATING TO CANNABIS.

Authorizes the Department of Health to approve in-vehicle receipt of medical cannabis and medical cannabis products on or near the premises of dispensaries subject to administrative rules the Department of Health promulgates. (SD1)

RELATING TO POLLUTION ABATEMENT.

MAKING AN APPROPRIATION FOR THE OFFICE OF THE LONG-TERM CARE OMBUDSMAN PROGRAM.

Establishes and appropriates funds for five permanent Long-Term Care Ombudsman Program Specialist Positions within the Office of the Long-Term Care Ombudsman, assigned to each county as follow: one for the City and County of Honolulu, one for the county of Maui, two for the county of Hawaii, and one for the county of Kauai. Requires the Long-Term Care Ombudsman Program Specialist to work under the supervision of the Long-Term Care Ombudsman to achieve the goals of the Long-Term Care Ombudsman Program, as mandated by the federal Older Americans Act. RELATING TO THE STATEWIDE TRAFFIC CODE.

Requires any person operating a vehicle with an ignition interlock to have government issued identification in their immediate possession. Expands the offense of circumventing or tampering with an ignition interlock to include obscuring the camera lens or not providing a picture of the driver. Establishes a new fine for those who operate or assume actual physical control of a motor vehicle while having a blood alcohol content of .05-.08. Effective 1/1/2050. (SD1)

MAKING AN EMERGENCY APPROPRIATION TO FUND A GRANT TO THE BOARD OF WATER SUPPLY FOR EMERGENCY OPERATIONS, FUTURE PLANNING, AND GROUND WATER REMEDIATION.

Makes an emergency appropriation to the City and County of Honolulu Board of Water Supply for emergency operations, future planning, and remediation resulting from the contamination of the Southern Oahu Basal Aquifer; provided that the Department of Health seeks to enter into a memorandum of understanding with the United States Navy to reimburse the full amount of the appropriation. Effective 1/1/2050. (SD1)
