RELATING TO HEALTH.

Requires assessment of patients who are subject to emergency hospitalization, diagnosed with a mental illness or severe substance use disorder, and found to be lacking decisional capacity to determine if a surrogate or guardian needs to be appointed to make appropriate health care decisions for the patient. Authorizes certain health care providers to make determinations on the presence of mental illness, substance abuse disorder, and decisional capacity of the patient. Effective 1/1/2050. (SD1)

RELATING TO TARO.

Establishes an exclusion from the state income tax for an unspecified portion of a person's income derived from the business of taro cultivation or production of taro products. Provides that the exclusion shall not apply if the department of agriculture determines that more than 30,000 acres of land is used for locally grown taro. Effective 7/1/2050. (SD2)

RELATING TO WATER CATCHMENT SYSTEMS.

Requires the Department of Health to regulate water catchment systems used for business activity and provide testing to businesses that utilize water catchment systems; provided the regulations comply with the Hawaii state plumbing code, including appendix K of the state plumbing code, and Chapter 448E, Hawaii Revised Statutes. Requires the department to provide technical assistance on water catchment systems and filtration to business owners who wish to utilize captured water for business activities. Effective 1/1/2050. RELATING TO ELECTRONIC EAVESDROPPING.

Amends provisions relating to electronic eavesdropping. Requires law enforcement entities to obtain a search warrant before accessing a person's electronic communications in certain circumstances. Amends notification requirements of a law enforcement entity's access to electronic communications to allow for discovery in criminal cases.

RELATING TO UNDERGROUND FUEL STORAGE TANKS.

Prohibits issuance of future large capacity underground storage tank systems mauka of the underground injection control line beginning July 1, 2022. Prohibits operation of and renewal of large capacity underground storage tank system permits located mauka of the underground injection control line beginning January 1, 2023. Defines large capacity underground storage tank system and underground injection control line. Effective 7/1/2050. (SD2)
