RELATING TO PLANNED COMMUNITIES.

Requires the counties to designate an agency to inform the public and hold a hearing when lands included in a community master plan are proposed for sale and intended to be used for a purpose other than as proposed in the master plan. Takes effect on 07/01/2050. (SD1)

RELATING TO TOWING.

Requires owners or operators of ticket issuing machines to list a customer service number on the machine. Requires a person who is parking in a stall that is paid for by a ticket issuing machine to contact the owner or operator of the machine if the machine is inoperable within two hours to avoid being subject to towing. Requires the owner or operator of the inoperable ticket issuing machine to provide an attendant at the machine within thirty minutes. Prohibits a towing company from towing a vehicle that is parked in a parking stall that would otherwise require a person to pay for parking by means of a ticket issuing machine if the machine is inoperable if certain conditions are met. RELATING TO OPEN GOVERNMENT.

Requires the office of information practices to resolve all public complaints about noncompliance with chapter 92F and part I of chapter 92 within six months from the date the office of information practices receives the complaint.

RELATING TO CONDOMINIUMS.

Clarifies the process, including payment obligations, mediation requirements, and triggers for further default, where a condominium unit owner and association reach a payment plan to resolve a nonjudicial foreclosure. Establishes procedures that provide condominium owners with the right to submit disputed legal fees, penalties or fines, late fees, lien filing fees, or other charges, except for common expense assessments, to the mediation process prior to payment.

RELATING TO EMPLOYMENT.

Amends the definition of "employer" in chapter 388, HRS, to include the State and counties when a provision in that chapter has no comparable provision in chapter 78, HRS.

RELATING TO FIRE SAFETY.

Provides interest-free loans to condominium associations to retrofit or install automatic fire sprinklers or sprinkler systems. Appropriates an unspecified sum to the Hawaii housing finance and development corporation for the interest-free loans. Effective 7/1/2050. (SD1)

RELATING TO CONDOMINIUM PROPERTY REGIMES.

Prohibits the use of storage sheds, equipment sheds, or other structures appropriate to the agricultural activity carried on within leased agricultural lands for residential purposes for any length of time. Repeals the exemption for agricultural lands that are subdivided and leased for agricultural uses or activities from compliance with county subdivision standards. Requires condominium property regimes to comply with county subdivision requirements. Repeals the exemption for certain condominium property regimes that are to be sold for $1,000,000 or more from mandatory registration with the real estate commission. Requires that an application for registration of a project in a county agricultural zoning district or preservation zoning district include a verified statement, signed by an appropriate county official, that the project is in compliance with any supplemental county ordinances and rules. RELATING TO STUDENT HEALTH.

Allows schools to stock auto-injectable epinephrine. Authorizes designated school personnel to provide epinephrine to student for self-administration. Requires training to designated school personnel in the administration of insulin, glucagon, and auto-injectable epinephrine.

RELATING TO ELECTRONIC EAVESDROPPING.

Prohibits the State and its political subdivisions from collecting or using a person's electronic data or metadata by means of a cell site simulator device, except under certain conditions. Prohibits the installation and use of a cell site simulator device without a court order. Specifies conditions when a cell site simulator device may be used. Specifies procedures for application and issuance of an order for a cell site simulator device. Specifies reporting requirements related to cell site simulator device applications. (SD1)

RELATING TO BICYCLES.

Requires the driver of a vehicle overtaking a bicycle proceeding in the same direction to allow at least a three-foot separation between the right side of the driver's vehicle and the left side of the bicyclist.
