Beginning 1/1/2019, requires all users of restricted use pesticides to be subject to a requirement to report on their use of restricted use pesticides to the Department of Agriculture (DOA). Prohibits the use of a restricted use pesticide on or within 100 feet of a school during normal school hours beginning on 1/1/2019. Prohibits the use of pesticides containing chlorpyrifos as an active ingredient beginning 1/1/2019; provided that the DOA shall grant any person, upon request, a temporary permit allowing the use of pesticides containing chlorpyrifos through 12/31/2022. Provides for the deposit into the pesticide use revolving fund of all penalties and fines collected under the Hawaii Pesticides Law. Revises the ceiling and use of the pesticide use revolving fund. Requires the DOA to develop a pesticide drift monitoring study no later 7/1/2019. Appropriates general funds for the pesticide drift monitoring study, establishment of two full-time equivalent positions, and outreach and education. (CD1)
Requires employers to pay for all medical services required for the employee for the compensable injury and the process of recovery, even when claims are disputed. Establishes negotiation, notice, and review procedures for disputed claims. Imposes fines and penalties for failure to negotiate in good faith. Requires all government procurement officers to attend a training and development program prior to participating in or authorizing any procurement. Requires all government procurement officers to complete review training every three years. Requires all procurement officers, department heads, and their deputies, except for the administrator of the State Procurement Office, to attend mandatory procurement training within ninety days of appointment. Requires the Legislative Reference Bureau to conduct a study on the feasibility of implementing the Hawaii Retirement Savings Program and to submit to the Legislature a report detailing its findings and proposals. If the results of the study are positive, a Hawaii Retirement Savings Board is established to administer the Hawaii Retirement Savings Program and the Hawaii Retirement Savings Program Administrative Fund. Requires the Board to annually report to the Governor and Legislature. Gives the Department of Budget and Finance interim rule making authority. Appropriates moneys. (SB2333 HD1)
Requires any governmental body that enters into a contract that is exempt from the State Procurement Code pursuant to Section 103D-102(b), Hawaii Revised Statutes, such as a contract for procurement of services of attorneys employed or retained to provide legal services to the State or any of its agencies, to report that contract to the State Procurement Office and Legislature. Prohibits the shipment of tobacco products, and the transport of tobacco products ordered or purchased through a remote sale, to anyone other than a licensee. Makes all provisions of the cigarette tax and tobacco tax law that relate to tobacco products applicable to e-liquid. Increases the license fee for wholesalers or dealers and the retail tobacco permit fee. Amends the taxes on cigarettes and tobacco products. Increases the excise tax for each cigarette or little cigar sold, used, or possessed by a wholesaler or dealer. Increases the excise tax on the wholesale price of each article or item of tobacco products, other than large cigars, sold by the wholesaler or dealer. Establishing an electronic smoking device retailer registration unit within the Department of the Attorney General. Amends the Penal Code. Regulates the delivery and sale of electronic smoking devices to purchasers within the State. (SB2654 HD2)
Requires that revenue estimates provided by the Department of Taxation to the Legislature or to any executive or administrative office with respect to proposed legislation be accompanied by a description of the methodology used and assumptions made in providing the estimate. Requires that the estimate and description be open to public disclosure. (SB2257 HD1)
