RELATING TO PROPERTY.

Increases the value amounts applicable to qualifying for an exemption from attachment or execution of real and personal property. Exempts one month of child support and spousal support in the possession of the debtor-recipient of support from attachment or execution. (HB193 HD1)

RELATING TO CRIMINAL DEFENDANTS' FITNESS TO PROCEED.

Provides that the court may appoint one qualified examiner instead of three, to evaluate a criminal defendant's fitness to proceed or regaining fitness to proceed in all penal cases and removes the requirement that examiner shall be from within the Department of Health. On July 1, 2022, the requirement shall be three qualified examiners for felony cases and one examiner in non-felony cases. One of the examiners shall be from within the Department of Health. RELATING TO SIDEWALKS.

Establishes and funds a two-year pilot school sidewalk maintenance and repair program that requires counties to maintain and repair sidewalks in school zones or other areas of significant school related pedestrian traffic. Requires each county to report on the status of the pilot program.

RELATING TO THE MORTGAGE INTEREST DEDUCTION.

Eliminates the mortgage interest deduction for second homes under the Hawaii Income Tax Law. Specifies that the revenue gain attributable to this measure be deposited into the Rental Housing Revolving Fund. Requires the Department of Budget and Finance, in consultation with the Department of Taxation, to submit reports on the administration of this measure to the Legislature prior to the 2018, 2019, 2020, 2021, and 2022 Regular Sessions.
