Amends certain land subdivision and condominium property regime laws related to agricultural land, as recommended pursuant to Act 278, Session Laws of Hawaii 2019, to ensure condominium property regime projects within the agricultural district are used for agricultural purposes.
Requires the Department of Health to establish a task force to plan the certification and training process for community health workers and submit a report to the legislature. (SD1)
Requires agencies that collect receipts for any disposition of the public land trust shall each fiscal quarter transfer to the department of Hawaiian home lands or the Office of Hawaiian Affairs twenty per cent of each receipt from the disposition. Provides to the department of Hawaiian home lands certain moneys previously claimed as public land trust overpayments to the office of Hawaiian affairs. Establishes a public land trust revenues negotiating committee exempted from part I of chapter 92, Hawaii Revised Statutes. (SD1)
Authorizes advanced practice registered nurses to certify whether a person is totally disabled under the income tax code. Authorizes advanced practice registered nurses to make capacity determinations. Adds advanced practice registered nurses as primary providers in advance mental health care directives. Creates the Hawaii Diversification and Resilience in a Vibrant Economy Program (HI DRiVE) and special fund, which requires the Hawaii technology development corporation to build on small business innovation research phase II awards and use funds to support phase III efforts to commercialize technology, develop manufacturing infrastructure, acquire equipment or materials, and support training or quality systems. Requires the governor to apply for $100,000,000 in economic diversification assistance from the federal government for the creation of the HI DRiVE program.
Defines serious crime as murder or attempted murder in the first degree or class A felony, or a call B or C felony involving violence of threat of violence. Allows the court to determine if bail may be denied where the charge is for a serious crime. Requires the judicial council to appoint a committee to review and recommend changes to the Hawaii penal code. Takes effect 7/1/25. (SD1)
Increases the advance disposal fee collected on glass containers. Removes the exemption for glass deposit beverage containers. Effective 7/1/2050. (SD1)
Creates a state lottery to begin by 1/1/2023. Creates the state lottery commission, state lottery account, and lottery administration account. Requires certain amounts of lottery revenues to be deposited into the administrative account, general fund, and special funds for university facilities and operations and public school operations. Creates a cultivation facility license, which allows cultivators to grow cannabis for sale to licensed dispensaries. Establishes requirements for license application and qualifications for license holders. Establishes requirements for cultivation facility operations, including plant tracking and testing. Clarifies that cultivation facilities may sell product only to licensed dispensaries. Authorizes the Department of Health to determine the number of cultivation licenses to be issued. Allows one cultivation license to be issued per tax map key number. Limits the number of cannabis plants grown at each cultivation facility to one thousand. Effective 7/1/2050. (SD1)
