RELATING TO CHILD PASSENGER RESTRAINTS.

Amends requirements for child passengers. Requires rear facing child safety seats for children less than two years of age. Requires the use of child safety seats or booster seats for certain children less than ten years of age. Raises certain fines for violations. Effective 7/1/2050. (SD1)

RELATING TO THE VENDING FACILITIES PROGRAM.

Allows persons with a mental illness to participate in the vending facilities program. Limits vending facilities owned or operated by persons with mental health disorders to only those state or county public buildings not currently occupied by blind or visually handicapped vendors.

RELATING TO ROADS.

Establishes a road connectivity task force to assess and identify ways of improving road access in rural areas and in subdivisions with substandard roads. Requires a report to the legislature.

RELATING TO GARDENS.

Authorizes the Department of Education to develop programs to encourage the development of gardens on school property. Authorizes the Hawaii Community Development Authority to develop programs that provide incentives to establish gardens in housing projects, communities, and schools.

RELATING TO FAMILY COURT.

Amends provisions relating to criteria and procedures in family court determinations regarding custody and visitation rights. Clarifies that a parent's felony conviction for a violent or sexual offense in which the victim was a minor, or requirement to register as a sex offender, raises a rebuttable presumption that custody or visitation by that parent is not in the best interest of the child. Requires courts to consider registration as a sex offender a presumption of risk that affects the burden of producing evidence. Requires courts to state reasons for findings in writing or on the record, including specific findings that there is no risk to the child's health, safety, and welfare.

RELATING TO THE HAWAIIAN HOMES COMMISSION ACT.

Defines "beneficiary consultation". Prohibits the department of Hawaiian home lands from disposing or extending a general lease to non-beneficiaries unless there are no applicants seeking to enter into a general lease to the use and occupancy of a tract of Hawaiian home lands. Requires the department to notify beneficiaries through beneficiary consultation prior to the disposition of Hawaiian home lands. Adds language to require Section 204 lessees mandate Homestead Beneficiary Agreements. Prohibits the department from establishing additional criteria to enter into a general lease with an applicant, under certain conditions. Specifies that the department may grant a license or enter into a general lease, under certain conditions. Allocates the interest or other earnings from the Hawaiian home loan fund and Hawaiian home general loan fund into their respective funds, under certain conditions. Requires the department to submit a quarterly report to the legislature and beneficiaries. Authorizes the department to negotiate with homestead association governed water agencies to maintain water systems prior to other service providers, under certain conditions. Effective 1/1/2050. RELATING TO FIREWORKS.

Specifies that certain violations of the Fireworks Control Law shall be considered an activity that causes air pollution under the Hawaii Air Pollution Control Act and a violation of noise control rules under the Hawaii noise pollution laws, and punishable by civil penalties and subject to citations under those respective laws. Effective 1/1/2050. (HD2)

RELATING TO BULLYING.

RELATING TO THE HOSPITAL SUSTAINABILITY PROGRAM.

Extends the hospital sustainability program through 6/30/2024. Increases the maximum fee for inpatient care services to 5.5%. Increases the amount of time hospitals have to pay the hospital sustainability fee from 30 days to 60 days. Increases the pool of medicaid services that can be used for matching purposes. Appropriates funds. Effective 6/29/2050. (SD2)
