RELATING TO CONSUMER PROTECTION.

Transitions from lump sum deferred deposit transactions to installment-based small dollar loan transactions. Specifies various consumer protection requirements for small dollar loans. Beginning 1/1/2020, requires licensure for small dollar lenders that offer small dollar loans to consumers. Specifies licensing requirements for small dollar lenders. Authorizes the division of financial institutions to appoint 2.0 FTE examiner positions, funded via the compliance resolution fund, to carry out the purposes of the small dollar installment loan program. Requires check cashers to be registered with DCCA and to offer a voluntary payment plan to customers under certain circumstances. Establishes the terms of voluntary payment plans. Clarifies that a customer may only have one outstanding deferred deposit transaction from any source. Amends notices to customers required of check cashers. Removes the exemption for persons engaged in the bona fide retail sale of goods or services. Requires the Auditor to conduct a sunrise analysis of the regulation of payday lenders and deferred deposit agreements in the State. (SB537 HD3)

RELATING TO THE GENERAL EXCISE TAX.

Exempts from the general excise tax gross receipts from the sale of mobility enhancing equipment, hearing aids, prosthetic devices, durable medical equipment, and prescription drugs sold pursuant to a doctor's prescription. Amends the definition of "prosthetic device" to include a replacement, corrective, or supportive device worn on or in the body. (SB530 HD1)

Establishes a task force to review policy issues and opportunities relating to the navigation, access, and coverage of medicaid services by individuals with autism or fetal alcohol spectrum disorder and make a recommendation on whether a waiver or other approval from the Centers for Medicare and Medicaid Services is necessary to ensure accessibility of certain services for individuals with autism or fetal alcohol spectrum disorder. RELATING TO ELECTRIC VEHICLES.

Prohibits the issuance of building permits pursuant to an application initiated on or after January 1, 2020, for all new residential multi-family buildings that have ten or more parking stalls and new commercial buildings that have twenty or more parking stalls unless a certain percentage of the parking stalls are electric vehicle charger ready, subject to superseding county ordinances. RELATED TO THE PRACTICE OF BEHAVIOR ANALYSIS.

Clarifies exemptions from licensure as a behavioral analyst for general education teachers, direct support workers, special education teachers, and teacher trainees working in collaboration with or under the supervision of licensed professionals. Requires the DOE to seek approval by the Centers for Medicare and Medicaid Services to amend the Hawaii Medicaid State Plan to provide reimbursement for applied behavior analysis services. RELATING TO THE HAWAII TECHNOLOGY DEVELOPMENT CORPORATION.

Requires the Department of Business, Economic Development, and Tourism (DBEDT) to engage a consulting firm to conduct a study to evaluate policies and organizational changes needed within DBEDT that will enable the State to successfully execute a technology-based economic development strategy. RELATING TO ENTERPRISE TECHNOLOGY SERVICES.
