Establishes an exemption from mediation in parentage proceedings where there are allegations of domestic abuse. Clarifies the exemption from mediation in divorce proceedings as it relates to domestic abuse.
Establishes uniform statewide requirements for policies and processes for the issuance of U and T visa certifications for noncitizen victims of crime that are consistent with federal laws and regulations governing U and T visas. Requires each state and county certifying entity to adopt a policy and process for the issuance of U and T visa certifications, consistent with those statewide requirements. Appropriate funds for the Department of the Attorney General to provide training to state and county certifying entities so that the policies and processes comply with all federal requirements. Appropriates funds to the Department of the Attorney General for the training.
Establishes the nonconsensual disclosure of intimate or private images as a criminal offense. Amends the criteria for an extended term of imprisonment to include an offender whose act of attempting to commit or committing the nonconsensual disclosure of intimate or private images against a minor or vulnerable adult resulted in the victim's death.
Restricts transfer fees relating to sale or transfer of ownership charged by condominium associations and planned community associations. Requires associations to disclose certain estimated withholdings and pass-through charges.
Requires state and county law enforcement agencies to notify an individual in the custody of a state or county law enforcement agency of their rights before any interview with the United States Immigration and Customs Enforcement pertaining to certain matters regarding civil immigration violations can commence. Designates all records relating to United States Immigration and Customs Enforcement access to detained individuals provided by a state or local law enforcement agency as public records. Requires state and county law enforcement agencies that have provided the United States Immigration and Customs Enforcement access to a detained individual within the previous year to hold two public forums per year.
Prohibits restaurants from imposing a mandatory gratuity service charge for food or beverage services unless the party includes ten or more customers, the service charge does not exceed eighteen per cent, and the customer is notified of the service charge.
Requires the Department of Health to adopt rules mandating that each primary caregiver and substitute caregiver in a Community Care Foster Family Home be a licensed nurse or certified nurse aide. Makes the requirements for primary and substitute caregivers applicable to all Community Care Foster Family Homes, regardless of the number of clients in the home.
Designates the Department of Land and Natural Resources as the primary agency for the trapping of feral goats, sheep, and pigs. Requires the Department to establish a program to humanely manage populations of feral goats, sheep, and pigs in the State by trapping.
Creates an expedited permitting process to authorize the destruction or control of feral pigs on privately owned land, if the feral pigs have caused or are likely to cause substantial damage to agricultural or aquacultural crops, indigenous plants or wildlife, or pose a threat to human health and safety.
Establishes the hike safe card program and search and rescue special fund to be administered by the Department of Land and Natural Resources. Requires government entities to seek reimbursement for all or a portion of search or rescue expenses when the person or entity knowingly enters state, county, or private property, knowingly enters a hiking trail that is closed to the public, or violates applicable laws, provided that the closure is posted by sign, barricade, or other device that gives reasonable notice of the closure. Exempts persons who possess a hike safe card from search and rescue cost reimbursement, under certain conditions. Requires counties and the State Fire Council to adopt ordinances or rules as necessary to pursue reimbursements. Raises the penalty for criminal trespass from a petty misdemeanor to a misdemeanor. Makes appropriations.
