RELATING TO VEGETATIVE BURNING.

Prohibits the Department of Health from issuing permits for commercial burning of green waste products in residential areas or within one thousand feet of a residential property.

RELATING TO CIVIL RIGHTS.

Requires entities with state education programs or activities, or that receive state funding for educational programs or activities, to adopt written policies and undertake other specified actions no later than 1/1/2023. RELATING TO FARMER EQUITY.

Establishes provisions within the department of agriculture to enhance farmer equity by ensuring inclusion of socially disadvantaged farmers and ranchers in the development, implementation, and enforcement of food and agriculture laws, rule, policies, and programs. Requires an annual report to the legislature.

MAKING AN APPROPRIATION FOR THE OFFICE OF THE LONG-TERM CARE OMBUDSMAN PROGRAM.

Establishes and appropriates funds for five permanent Long-Term Care Ombudsman Program Specialist Positions within the Office of the Long-Term Care Ombudsman, assigned to each county as follow: one for the City and County of Honolulu, one for the county of Maui, two for the county of Hawaii, and one for the county of Kauai. Requires the Long-Term Care Ombudsman Program Specialist to work under the supervision of the Long-Term Care Ombudsman to achieve the goals of the Long-Term Care Ombudsman Program, as mandated by the federal Older Americans Act. RELATING TO THE DEPARTMENT OF HUMAN SERVICES.

Appropriates funds for the operating budget of the department of human services for fiscal year 2022-2023. Requires the Department of Human Services to make any and all efforts available each year to fully fund all programs relating to homelessness. (SD1)

RELATING TO BOARDS AND COMMISSIONS.

Provides for the term expiration of a holdover member of a board or commission at the end of the first regular legislative session following the expiration of the member's term. Requires the Governor to appoint an individual to fill all board and commission vacancies within one hundred eighty days. Authorizes the President of the Senate to nominate a successor member for a board or commission in certain circumstances. Limits holdover appointments in certain respects. Requires department heads to inform the Governor of any vacancy in any board or commission. Makes conforming amendments. (SD1)

RELATING TO THE STATEWIDE TRAFFIC CODE.

Requires any person operating a vehicle with an ignition interlock to have government issued identification in their immediate possession. Expands the offense of circumventing or tampering with an ignition interlock to include obscuring the camera lens or not providing a picture of the driver. Establishes a new fine for those who operate or assume actual physical control of a motor vehicle while having a blood alcohol content of .05-.08. Effective 1/1/2050. (SD1)

RELATING TO HIGHWAYS.

Allows any county or state agency responsible for maintenance of a highway to recover from the owner or driver of a vehicle the actual cost of removal of materials dropped or spilled on the highway. Makes an appropriation to the Department of Transportation for signage to inform the public about laws relating to littering.

RELATING TO AQUACULTURE.

Establishes within the Department of Agriculture, an Aquacultural Area Lease Program for the purpose of identifying state facilities, state lands, and state marine waters that are suitable for use as commercial agricultural areas and leasing them to be used for aquaculture. Allows agencies having control and management of identified aquacultural areas to lease the facilities, lands, and waters to the Department of Agriculture for the purposes of the Act. Allows the program to use the moneys in the Aquaculture Development Special Fund to carry out the purposes of the Act and requires the revenues obtained from aquacultural area leases to be deposited into the special fund. Imposes penalties and civil and criminal liabilities. Exempts the program from being subject to the Hawaii Ocean and Submerged Lands Leasing Act. (SD1)
