Establishes statewide goals for solid waste reduction and organic waste diversion. Requires each county to incorporate into its next integrated solid waste management plan revision a plan to reduce all organic waste produced within the county by facilities generating more than a specified amount of organic waste per year in alignment with established state benchmarks. Prohibits certain covered educational entities and Hawaii Health Systems Corporation facilities from collecting information regarding citizenship or immigration status or allowing officers of Immigration and Customs Enforcement to enter certain facilities, except under specific circumstances.
Amends the definition of "child abuse or neglect" by clarifying that the failure to provide certain needs to a child constitutes child abuse or neglect only if the person or entity responsible for the care of the child is financially able to provide and fails to do so or is offered financial or other reasonable means to provide and fails to accept these offers.
Requires and appropriates funds to pay salary differentials to English language educators as an incentive to attract and retain these educators. Appropriates funds.
Requires the State to defend professionally licensed or certified state employees from civil actions or proceedings, under certain circumstances. Clarifies that the employee may employ their own attorney at the employee's own expense. Establishes a process for the Attorney General to transfer or withdraw representation if the Attorney General declines to defend the employee.
Establishes a Plant Nursery Registry Program to regulate the sale of nursery stock. Requires certain plant nurseries to register with the Department of Agriculture. Establishes penalties. Effective 7/1/3000. (HD1)
Restricts civil asset forfeiture to cases involving the commission of a felony offense where the property owner has been convicted of an underlying felony offense. Directs forfeiture proceeds to the general fund. Amends the allowable expenses for moneys in the Criminal Forfeiture Fund. Requires the Attorney General to adopt rules necessary to carry out the purpose of the Hawaii Omnibus Criminal Forfeiture Act. Amends the deadline for the Attorney General to report to the Legislature on the use of the Hawaii Omnibus Criminal Forfeiture Act. Limits the transfer of certain forfeiture property to federal agencies. Establishes records requirements.
Amends the Hawaii State Constitution to prohibit the State from denying or interfering with an individual's reproductive freedom, including the right to choose to obtain an abortion and to obtain or use contraceptives.
Requires claims of post-traumatic stress disorder suffered by first responders to be compensable under workers' compensation under certain conditions if the post-traumatic stress disorder resulted from the first responder acting within the course and scope of the first responder's employment. Defines "first responder." Exempts injuries caused by post-traumatic stress disorder from certain time limitations applicable to workers' compensation claims.
