RELATING TO THE ENVIRONMENT.

Requires Department of Land and Natural Resources to establish a Visitor Green Fee Program to collect fees from nonresidents via a license to use state natural and cultural resources, to be used for the protection, restoration, and care of Hawaii's natural, cultural, and outdoor recreational resources and build the resilience of these resources against the impacts of climate change and local threats. Establishes the Hawaii environmental legacy commission to rank project applications and make recommendations to the Board of Land and Natural Resources concerning the allocation of Visitor Green Fee Program Funds. Establishes the Hawaii Environmental Legacy Special Fund. (SD1)

RELATING TO REHABILITATION.

Expands the Criminal Justice Diversion Program. Amends the allowable period of court-ordered assisted community treatment and considerations for extensions. Allows courts to require certain probation violators to undergo mental health evaluation and treatment as a condition of continued probation. Requires DOH to contract with behavioral health crisis centers. Appropriates funds. Takes effect 03/22/2075. (SD1)

RELATING TO THE JUDICIARY.

Allows for judicial review of orders fixing minimum terms of imprisonment. Specifies that in any civil action brought by the petitioner seeking compensation of any kind or nature whatsoever as a result of, related to, or arising from a conviction and imprisonment for crimes for which the person was actually innocent, any recovery will offset, dollar for dollar, the total award made in the civil action against whom claims are asserted. Repeals section 661B-7, Hawaii Revised Statutes. Takes effect 03/22/2075. (SD1)

RELATING TO AN ATMOSPHERIC CARBON CAPTURE PLANT.

Directs the Hawaii State Energy Office, in conjunction with the Hawaii Natural Energy Institute, to develop and submit a strategy report to the Legislature by 2025 for the construction of at least one atmospheric carbon capture plant in the State by 2030. (SD1)

RELATING TO PRIVACY.

Modernizes the definition of "personal information" for the purposes of notifying affected persons of data and security breaches. Includes licensees subject to the Insurance Data Security Law pursuant to article 3B, chapter 431, Hawaii Revised Statutes, among the businesses deemed compliant with the chapter's security breach notice requirements. RELATING TO SEA LEVEL RISE ADAPTATION.

Requires each executive branch department to: identify existing and planned facilities that are vulnerable to sea level rise, flooding impacts, and natural hazards; assess options for mitigating the impacts of sea level rise to existing and planned facilities; establish staff level points of contact to improve interagency coordination for sea level rise adaptation, flooding, and resilience; and submit annual reports to the Governor, Legislature, and Hawaii Climate Change Mitigation and Adaptation Commission. RELATING TO HOMESTEAD EXEMPTIONS.
