Requires employers to provide employees with written notice of the employee's shift schedule at least ten calendar days before the employee is scheduled to work, under certain circumstances. Requires certain employers to pay their employees twice as much as their regular rate of pay for time worked when their shift schedule was not timely given.
Makes unlawful the sale of flavored products for electronic smoking devices, mislabeling of e-liquid products containing nicotine, and sale of tobacco products other than through retail sales via in-person exchange. Establishes penalties. Includes e-liquid and electronic smoking devices in the definition of "tobacco products" for purposes of the cigarette tax and tobacco tax law. Increases the license fee for wholesalers and dealers of tobacco products and retail tobacco permit fee. Requires retailers to pay an additional excise tax on the retail price of electronic smoking devices on and after 7/1/2021. Directs a certain percentage of moneys received from the cigarette tax and tobacco tax to the Hawaii tobacco prevention and control trust fund to establish and fund a comprehensive youth tobacco cessation program. Requires a person under twenty-one years of age who unlawfully purchases or possesses tobacco products, including electronic smoking devices, to complete a tobacco education or use cessation program or perform community service for a first offense. Repeals the electronic smoking device retailer registration unit. Repeals provisions relating to delivery of sales under the cigarette tax and tobacco tax law.
Increases the minimum wage for certain employees to $15.00 per hour beginning 6/1/2023.
Allows minors under the age of sixteen years to work in theatrical employment provided that the employer procures a valid certificate of employment and the minor is accompanied by a parent, guardian, or responsible adult designated by the parent or guardian, to supervise and advocate on behalf of the minor. Requires the employer to hire a nurse certified in basic life support to accompany, supervise, and advocate on behalf of an infant under the age one who is on set. Requires a studio teacher to accompany, teach, and attend to the health, safety, and well-being of a minor who attained the age of five years, is working during periods when the minor is legally required to attend school. Defines "nurse" and "studio teacher". Takes effect 1/1/2050. (SD1)
During a state of emergency or local state of emergency, provides parameters for delegation of powers and scope and duration of suspension of laws. Provides an advise and consent process for an emergency proclamation to extend beyond one hundred twenty days. Provides a legislative means for an emergency proclamation to be terminated.
Expands the definition of compensation to include overtime payments earned by essential workers during an unspecified period of time. Appropriates moneys to fund additional employees' retirement system costs.
