RELATING TO HISTORIC PRESERVATION.

Authorizes the state historic preservation division, in consultation with the office of Hawaiian affairs, to delegate the responsibility of historic preservation project reviews to the impacted county and establish a program for third-party individuals and organizations to conduct document reviews on proposed projects. RELATING TO EDUCATION.

Requires the superintendent of education, or the superintendent's designee, to serve as the summer learning coordinator and coordinate all summer programs for children. Requires the summer learning coordinator to work with the department of human services to leverage federal funds for school-based summer programs. (HD1)

RELATING TO THE MODERNIZATION OF CRIMINAL JUSTICE.

Eliminates the use of monetary bail, with certain exceptions, and requires defendants to be released on their own recognizance for traffic offenses, violations, non-violent petty misdemeanor offenses, and non-violent misdemeanor offenses. Creates a rebuttable presumption regarding both release and detention for certain offenses and specifies circumstances in which these presumptions apply. Requires the judicial council to appoint a committee to review and recommend changes to the Hawaii penal code.

RELATING TO SEX TRAFFICKING PREVENTION.

Requires the department of education to offer training for teachers, educational officers, and school-based behavioral health specialists on sex trafficking prevention and response.

RELATING TO CHARTER SCHOOLS.

Requires charter school authorizers to provide a list of approved independent auditors, rather than selecting three independent auditors, from which their respective charter school is to select an independent auditor for its annual financial audit. Effective 7/1/2050. (HD1)

RELATING TO LAW ENFORCEMENT.

Establishes an enforcement division in the department of the attorney general. Transfers to the department of the attorney general enforcement division the law enforcement activities of the department of land and natural resources, division of conservation and resources enforcement; the department of public safety state law enforcement officers and the narcotics enforcement division; and the department of transportation harbors division. Specifies the persons authorized to serve civil legal process. Mandates the attorney general to maintain a list of independent civil process servers. Shields the State and the department of the attorney general from liability arising from the acts of independent civil process servers. Effective 7/1/2022.

RELATING TO FARM TO SCHOOL PROCUREMENT.

Requires the department of education to establish rules for the procurement of goods and services related to the administration of food programs at public schools that incorporate a geographic preference for unprocessed locally grown and locally raised food products. Effective 7/1/2051. (HD2)

PROPOSING AN AMENDMENT TO ARTICLE I OF THE CONSTITUTION OF THE STATE OF HAWAII TO GUARANTEE ALL INDIVIDUALS THE RIGHT TO HAVE A CLEAN AND HEALTHY ENVIRONMENT.

Proposes a constitutional amendment that guarantees individuals the right to a clean and healthy environment, including pure water, clean air, healthy ecosystems, and a stable climate, and to the preservation of the natural, cultural, scenic and healthful qualities of the environment. Clarifies that the rights guaranteed may not be diminished by Article XI, Section 9, of the State Constitution. Effective 7/1/2050. (HD1)
