RELATING TO CARBON SEQUESTRATION INCENTIVES.

Establishes the Hawaii farmland and forest soil health carbon smart incentive program to incentivize carbon sequestration activities through incentives contracts that provide for compensation for eligible practices by program participants. Appropriates funds for positions and administering the program. Effective 7/1/2100. (HD2)

RELATING TO SEXUAL HEALTH EDUCATION.

Requires DOE to provide comprehensive training for teachers and educational officers on sexual health topics that include positive and accurate representations of the lesbian, gay, bisexual, transgender, queer or questioning, intersex, asexual, other sexual orientations and gender identities, persons of color, and disability communities to destigmatize and promote sexual health. Requires sexual health education programs to include similar sexual health topics to destigmatize and promote sexual health. Effective 7/1/2050. (HD1)

RELATING TO EXTERNAL CONTRACTS IN THE DEPARTMENT OF EDUCATION.

Requires the DOE, in consultation with and approval by the BOE, to develop and implement a plan to reduce the use of external contracts for curricula, instruction, and testing. Requires DOE to convene an advisory committee to make recommendations for developing and implementing the plan. Requires DOE to submit interim and final reports to the legislature. RELATING TO THE DEPARTMENT OF EDUCATION.

Establishes the shade and fruit tree program in the department of education to support educational activities and encourage propagation of native shade trees and fruit trees for planting in department schools. RELATING TO HABITAT CONSERVATION PLANS.

Requires any person, before engaging in an activity with a high likelihood of resulting in an incidental take of a threatened or endangered species, to enter into a planning process with DLNR for the purpose of preparing and implementing a habitat conservation plan. Requires habitat conservation plans to include additional components. Effective 7/1/2050. (HD2)

RELATING TO CATALYTIC CONVERTERS.

Requires licensed used motor vehicle parts dealers to keep certain records of catalytic converter purchases and shipments. Establishes the felony offense of theft of catalytic converter. Increases the penalty for engaging in certain business related to used motor vehicle parts and accessories without a license. Requires scrap dealers to keep records of purchases of palladium, platinum, and rhodium. Requires all scrap dealers or recyclers to pay for palladium, platinum, and rhodium, and used motor vehicle parts dealers to pay for catalytic converters, by check. Effective 1/1/2050. (HD2)

RELATING TO PROPERTY FORFEITURE.

Restricts civil asset forfeiture to specific, limited cases. Raises the burden of proof for property forfeiture to clear and convincing evidence. Authorizes the use of certain forfeited property by local or state agencies for a limited time. Directs forfeiture proceeds to certain involved state and local governments and to the general fund. Amends the allowable uses of moneys in the criminal forfeiture fund. Requires the Attorney General to adopt rules. Advances the deadline for the Attorney General to report to the Legislature on the Hawaii omnibus criminal forfeiture act. Effective 1/1/2222. (HD2)
