RELATING TO AGRICULTURE.

Clarifies that "customary and traditional subsistence farming", which is customary and traditional subsistence farming conducted by a native Hawaiian cultural practitioner in certain situations, is included as a protected activity under the Hawaii Right to Farm Act. Clarifies that the cultivation of crops and activities related to game, fish, and livestock on agricultural lands may be for economic use or customary and traditional subsistence farming. Provides that one of the State's policies under the Hawaii State Planning Act's agricultural objectives is to assure the right of native Hawaiian cultural practitioners to engage in customary and traditional subsistence farming for direct personal or family consumption. RELATING TO AGRICULTURAL LOANS.

Increases the Board of Agriculture Chairperson's authority to approve agricultural loans and aquacultural loans not to exceed $50,000 of state funds, rather than $25,000.

RELATING TO TAXATION.

Includes e-liquid and electronic smoking devices within the definition of "tobacco products", as used in the cigarette tax and tobacco tax law. Establishes a tax of twenty per cent for the wholesale price for electronic smoking devices and 10 cents for each milliliter of e-liquid. Allocates a portion of funds collected on excise taxes on electronic smoking devices and eliquids to the trauma system special fund, community health centers special fund, and emergency medical services special fund.

RELATING TO FEES.

Exempts the Department of Hawaiian Home Lands from permit and review fees for residential buildings for use by beneficiaries of the Hawaiian Homes Commission Act, 1920, as amended; provided that the department shall comply with applicable building, electrical, plumbing, and fire codes.

Disallows the enforcement of a re-recorded homeowners' association restriction if the restriction prohibits bona fide agricultural uses and activities on agricultural land.
