RELATING TO THE TRANSITION OF THE OAHU REGIONAL HEALTH CARE SYSTEM FROM THE HAWAII HEALTH SYSTEMS CORPORATION INTO THE DEPARTMENT OF HEALTH.

Commences the transfer of the Oahu regional health care system in its entirety from the Hawaii health systems corporation to the department of health, beginning with the transfer of the Oahu regional health care system's budget into the department of health. Enables the Oahu regional health care system, department of health, Hawaii health systems corporation, and other state agencies to manage and implement the processes required to effectuate the completion of the transition. Authorizes the department of health to conduct long-term care and substance abuse treatment at Leahi hospital and Maluhia and to pay rent for the use of the Leahi hospital property. Requires the department of health to consult with the university of Hawaii regarding programs at Leahi hospital and Maluhia. Clarifies the rights, powers, and exemptions of the Oahu regional system board during the transition period of the Oahu regional health care system into the department of health and the rights and powers of the department of health after the transition is completed. Appropriates monies from the mental health and substance abuse special fund. Authorizes the issuance of general obligation bonds. Part II effective 7/1/2023. Effective 7/1/2050. (SD1)

RELATING TO EDUCATION.

The purpose of this Act is to require transfer of nonfacility general fund per-pupil allocations of special education students of a department of education school to a charter school upon receipt of the completed intent to enroll form of the student at the charter school subject to certain conditions, including parent or guardian confirmation and notice of intent of the student's transfer to and enrollment in the charter school.

RELATING TO VICTIM-COUNSELOR PRIVILEGE.

Expands the victim-counselor privilege under Rule 505.5 of the Hawaii Rules of Evidence to include victims of dating violence, stalking, and sexual harassment and confidential advocates employed by the University of Hawaii. Effective 7/1/2060. (HD2)

RELATING TO ANIMAL CRUELTY.

Prohibits specified trolleys, trolleys with swivels, pulleys, cables, or running lines designed to attach a dog to two stationary objects in a configuration that endangers the dog, including by depriving the dog of sustenance. Prohibits tethering or restraining a dog under the age of six months unless the dog is engaged in an activity supervised by its owner or an agent of its owner. Prohibits tethering or restraining a dog with a tow or log chain. Prohibits tethering or restraining a dog with a choke collar, pinch collar, or prong collar unless the dog is engaged in an activity supervised by its owner or an agent of its owner.

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM.

Caps the service credit for unused sick leave for employees who become members of the employees' retirement system on or after 7/1/2021 at a maximum credit of ninety days. Specifies that any unused sick leave in excess of ninety days shall be forfeited.

RELATING TO INSPECTIONS OF CARE FACILITIES.

Specifies that plans of correction and the status of corrective actions for care facilities shall be added to reports by the department of health within five working days. Clarifies, for reporting purposes, that the conclusion of an inspection occurs after the initial visit to a facility is completed.

RELATING TO LOANS.

Transitions from lump sum deferred deposit transactions to installment-based short-term loans. Specifies various consumer protection requirements for short-term loans, including interest and fee caps, allowable outstanding loans, a cooling-off period, and the right to rescind. Beginning 1/1/2022, requires persons operating as short-term loan companies to be licensed. Specifies licensing requirements for short-term loan companies.

RELATING TO THE YOUTH VAPING EPIDEMIC.

Bans the sale of flavored tobacco products. Prohibits mislabeling of e-liquid products containing nicotine. Establishes fines and penalties for violations. Includes heated tobacco products among the electronic smoking devices that are subject to restrictions under law.
