Authorizes the board of land and natural resources to: (1) Amend and extend existing pasture leases for up to sixty-five years; (2) Issue new pasture leases by negotiation, if doing so furthers public purposes and the lands are already under pastoral use; and (3) Develop agricultural and pasture lease rents based on the value of the land's agricultural uses. Requires as a condition precedent for any valid withdrawal of lands out of pasture leases for reforestation purposes that the division of forestry and wildlife submit a funded action plan detailing the planned reforestation process for those lands and that the withdrawal be approved by the board of land and natural resources. Requires any person, before engaging in an activity with a high likelihood of resulting in an incidental take of a threatened or endangered species, to enter into a planning process with DLNR for the purpose of preparing and implementing a habitat conservation plan. Clarifies the group of professionals who are prohibited from knowingly referring or transferring patients to an uncertified or unlicensed care facility. Repeals the landlord exclusion. Requires the department of health to prioritize complaint allegations based on severity for inspections of state-licensed or state-certified care facilities. Effective 7/1/2060. (HD2)
Requires licensed used motor vehicle parts dealers to keep certain records of catalytic converter purchases and shipments. Establishes the felony offense of theft of catalytic converter. Increases the penalty for engaging in certain business related to used motor vehicle parts and accessories without a license. Requires scrap dealers to keep records of purchases of palladium, platinum, and rhodium. Requires all scrap dealers or recyclers to pay for palladium, platinum, and rhodium, and used motor vehicle parts dealers to pay for catalytic converters, by check. Effective 1/1/2050. (HD2)
Restricts civil asset forfeiture to specific, limited cases. Raises the burden of proof for property forfeiture to clear and convincing evidence. Authorizes the use of certain forfeited property by local or state agencies for a limited time. Directs forfeiture proceeds to certain involved state and local governments and to the general fund. Amends the allowable uses of moneys in the criminal forfeiture fund. Requires the Attorney General to adopt rules. Advances the deadline for the Attorney General to report to the Legislature on the Hawaii omnibus criminal forfeiture act. Effective 1/1/2222. (HD2)
Requires the department of land and natural resources to establish and implement a two-year stream maintenance reimbursement pilot program to reimburse homeowners for clearing debris in and around streams near their property. Appropriates funds. Effective 7/1/2050. (HD1)
Allows home-schooled, high school-age students to participate as unattached competitors in individual sports available to the public school that the student would otherwise be required to attend. Effective 7/1/2051. (HD1)
Repeals the requirement that a person only operates category 3 vehicles to qualify to drive commercially in the State. Repeals the requirement that an application for a commercial driver's license or commercial learner's permit include intrastate driver certification. Requires the department of transportation to amend its rules, and makes conforming statutory amendments, to lower the minimum age required for a commercial driver's license. Effective 1/1/2050. (HD2)
