Appropriates funds for the second year of a program to train incarcerated women to be general education development tutors for their peers, provide college correspondence courses for women in the women's community correctional center, and provide reentry and transition services for women wanting to continue their education post incarceration. Establishes the Women's Corrections Implementation Commission within the Department of Public Safety to provide oversight over state correctional facilities that incarcerate women, receive and investigate complaints from incarcerated women, monitor the criminal justice system's progress in implementing reforms, and monitor programs and data that are important to ensuring successful outcomes for women in the correctional system. Prohibits the construction, modification, or expansion of any waste or disposal facility on land that is near or above a significant aquifer as determined by the department of health, in consultation with the commission on water resource management. Effective 7/1/2100. (HD1)
Changes the name of the offense of negligent homicide to vehicular homicide. Recategorizes the penalty categories for each of the 3 degrees of the offense to the next highest level of severity. Establishes that a person who has been convicted of vehicular homicide in the first degree shall be sentenced without the possibility of suspension of sentence or probation. Prohibits any prosecutor from dismissing a charge of vehicular homicide in the first degree in exchange for a defendant's agreement to a change of plea on a lesser charge, or for any other reason, unless the charge is not supported by probable cause or cannot be proven at trial. For any prosecution of vehicular homicide in the first degree that alleges that the defendant operated the vehicle while having a concentration of alcohol of .08% or more in the defendant's blood or breath, establishes as an affirmative defense that the concentration was the result of the defendant's consumption of alcohol after the defendant stopped operation of the vehicle.
Requires the department of health to issue a certificate of stillbirth, upon request of the parent or parents named on a fetal death certificate issued in the case of a stillbirth. Appropriates funds.
Provides that any goods provided to any state agency by the correctional industries program shall be: (1) produced or manufactured by the program; or (2) pre-existing goods that are substantially altered or customized by the program for the purpose of facilitating use of the goods by a state agency.
Establishes a separate fee and charge for the inspection, quarantine, and eradication of invasive species contained in air freight brought into the State, to be used for the program at the airports. Establishes a fund for the revenues to be deposited into. Appropriates funds.
