RELATING TO FARM TO SCHOOL PROCUREMENT.

Requires the department of education to establish rules for the procurement of goods and services related to the administration of food programs at public schools that incorporate a geographic preference for unprocessed locally grown and locally raised food products. Effective 7/1/2051. (HD2)

RELATING TO LABOR.

Requires employers with five or more employees to provide meal and rest breaks under certain conditions. Requires employers to provide a minimum amount of paid sick leave to employees to be used to care for themselves or a family member who is ill or needs medical care.

RELATING TO DOMESTIC VIOLENCE.

Allows a narrow hearsay exception for statements made by domestic violence victims during the course of the first interaction with the responding law enforcement officers and before the arrest of the defendant, as long as the statement bears sufficient indicia of reliability. (SD1)

RELATING TO ELECTRONIC SMOKING DEVICES.

Makes unlawful the sale of flavored products for electronic smoking devices, mislabeling of e-liquid products containing nicotine, and sale of tobacco products other than through retail sales via in-person exchange. Establishes penalties. Includes e-liquid and electronic smoking devices in the definition of "tobacco products" for purposes of the cigarette tax and tobacco tax law. Increases the license fee for wholesalers and dealers of tobacco products and retail tobacco permit fee. Requires retailers to pay an additional excise tax on the retail price of electronic smoking devices on and after 7/1/2021. Directs a certain percentage of moneys received from the cigarette tax and tobacco tax to the Hawaii tobacco prevention and control trust fund to establish and fund a comprehensive youth tobacco cessation program. Requires a person under twenty-one years of age who unlawfully purchases or possesses tobacco products, including electronic smoking devices, to complete a tobacco education or use cessation program or perform community service for a first offense. Repeals the electronic smoking device retailer registration unit. Repeals provisions relating to delivery of sales under the cigarette tax and tobacco tax law.

RELATING TO SCHOOL FOOD PROGRAMS.

Requires the department of education conduct a comprehensive cost analysis of the department's food services and student meals programs to, in part, increase the use of locally grown agricultural products. Requires a report to the legislature. Effective 7/1/2050. (HD1)

RELATING TO PUBLIC LANDS.

Exempts lands set aside by the governor to HHFDC for the primary purpose of developing affordable housing from classification as public land subject to DLNR management. Provides that lands set aside to HHFDC and no longer needed for housing, finance, and development purposes be returned to the public trust administered by DLNR.

RELATING TO HEALTH.

Requires public schools, private schools, and public charter schools to have an employee trained to administer seizure disorder rescue medication. Exempts schools that do not have a student with a seizure disorder. Requires a seizure action plan for every diagnosed student and distribution of the plan to employees charged with supervising the student. Requires all principals, guidance counselors, and teachers to perform selfreview of seizure disorder materials annually.

RELATING TO INTERNET SERVICES.

Requires the public utilities commission to ensure consumers are provided with access to information services, including internet services, that are available at just, reasonable, and nondiscriminatory uncapped rates.

RELATING TO THE CLEAN WATER ACT.

Beginning 1/1/2031, prohibits underground injection unless authorized by a National Pollutant Discharge Elimination System permit obtained from the director of health.

RELATING TO ECONOMIC RECOVERY FOR RESTAURANTS.

Until 7/1/2026, allows restaurants to apply a restaurant service surcharge for the sale of food or beverage services, the revenues of which shall be used exclusively by the restaurants for economic recovery from COVID-19 impacts. Authorizes establishments with a class 2 restaurant liquor license to allow the consumption of liquor anywhere on the premises, including the restaurant's outdoor property and sell liquors in their original packages for pick up, delivery, take out, or other means for off-premises consumption.
