RELATING TO SCHOOL IMPACT FEES.

Excludes housing developed by the Department of Hawaiian Home Lands from school impact fees for 3 years. Allows construction cost component impact fees to be used to improve or renovate existing structures for school use. Repeals the prohibition against expending construction cost component impact fees for portable or temporary facilities. Repeals the requirement that an expenditure plan for all collected impact fees be incorporated into the Department of Education's annual budget process. (SD2)

RELATING TO ACCESS TO LEARNING.

Authorizes the department of education to directly accept private funding for the purpose of establishing public prekindergarten programs under certain circumstances. Establishes the Hawaii early childhood educator stipend program to address shortage of early childhood education educators. Establishes the Hawaii early childhood educator special fund. Extends certain effective dates for implementation of Act 46, SLH 2020. Requires the application of a uniform assessment for public and charter school kindergarten students. Allows educational data to be shared using an existing system. Appropriates funds. Repeals and abolishes the Hawaii early childhood educator special fund on 6/30/2023. (CD1)

RELATING TO A BLACK CINDER CONE QUARRY SITE SURVEY.

Requires the department of land and natural resources, in collaboration with the county of Hawaii, to conduct site surveys to identify the most suitable locations for black cinder cone quarries on the island of Hawaii. Requires a report to the legislature. Appropriates funds. (CD1)

RELATING TO SEA LEVEL RISE ADAPTATION.

Requires the Office of Planning, in cooperation with each state agency having operational responsibilities over state facilities, to: identify existing and planned facilities that are vulnerable to sea level rise, flooding impacts, and natural hazards; assess a range of options to mitigate the impacts of sea level rise to those facilities; and submit annual reports to the Governor, Legislature, and Hawaii climate change mitigation and adaptation commission regarding the vulnerability and adaptation assessments for state facilities and the progress made in implementing sea level rise adaptation in future plans, programs, and capital improvement needs and decisions. Amends the Hawaii State Planning Act to include sustainable development, climate change adaptation, and sea level rise adaptation as objectives for facility systems. (CD1)

RELATING TO THE LOW-INCOME HOUSING TAX CREDIT.

Clarifies when and how members or partners of a taxpayer may claim the low-income housing tax credit. Requires a Form 8609 for purposes of claiming the tax credit. Specifies the application of tax provisions with respect to buildings or projects placed in service after 12/31/2020. Extends the sunset date of Act 129, Session Laws of Hawaii 2016, to 12/31/2027. RELATING TO EMPLOYMENT PRACTICES.

Prohibits employers, with certain exemptions, from requiring employees and prospective employees to download to their personal communication device, a mobile application that enables the employee's location to be tracked or the employee's personal information to be revealed, as a condition of employment or continued employment. Prohibits employers from terminating, discharging, or otherwise discriminating against an employee for refusing to download or refusing to consent to download the mobile application to the employee's personal communication device; or opposing any practice forbidden by this Act or filing a complaint, testifying, or assisting in any proceeding concerning an unlawful practice prohibited under this Act. Allows a person who alleges a violation of this Act to bring a civil action for injunctive relief, actual damages, or both. Sets fines. (CD1)

RELATING TO HOUSING.

Establishes an affordable homeownership revolving fund within HHFDC to provide loans to nonprofit community development financial institutions and nonprofit housing development organizations for the development of affordable homeownership housing projects. Appropriates American Rescue Plan Act funds for fiscal year 2022-2023 for providing loans to nonprofit community development financial institutions and nonprofit housing development organizations for the development of affordable homeownership housing projects. RELATING TO CRIMES AGAINST SENIORS.

Lowers the age at which enhanced penalties apply for crimes against seniors from sixty-two years of age to sixty years of age. Makes commission of certain criminal offenses against a senior's person or property applicable if the perpetrator knows or reasonably should know the senior victim's age. (SD1)
