Rep. Sonny Ganaden

Requires the department of taxation to share information with the department of labor and industrial relations for the purposes of enforcing the tip credit. Requires the department of taxation to provide an online tool or program to employers to determine compliance with the tip credit. Increases the minimum wage to $15.00 per hour by 2024 and indexes future annual increases to the median wage for all occupations in the State. Beginning 01/01/2022, adjusts the tip credit to 50 cents for every dollar above a certain amount. Requires written notice to an affected tipped employee.

Requires a public investment fund to develop, publish, and implement socially responsible investment policies applicable to the management of all public funds under the public investment fund's control and submit an annual report to the legislature on disclosing its investments in accord with environmental, social, and governance investing and socially responsible investment policies.

Includes under the offense of promoting gambling in the first degree the act of hosting activities that advance gambling activity on real property. Permits the forfeiture of real property to the State if the real property was used to promote gambling in the first degree by a person in at least three separate incidents and the person was convicted for at least three of those incidents.

Authorizes the board of land and natural resources to provide shoreline encroachment easements that do not exceed 10 years to landowners having structures that encroach on the shoreline. Requires the board of land and natural resources to adopt rules that establish a policy and procedure for the granting or renewal of shoreline encroachment easements. Requires the adopted policy to consider the impact of expected sea level rise on the encroaching structures. Prohibits the granting of any new shoreline encroachment easements until the new policy is adopted.

Specifies the documentation needed for a military spouse to receive a temporary licensure by endorsement. Requires issuance of the license within 30 days of the application and supporting documents.

Eliminates the use of monetary bail, with certain exceptions, and requires defendants to be released on their own recognizance for traffic offenses, violations, non-violent petty misdemeanor offenses, and non-violent misdemeanor offenses. Creates a rebuttable presumption regarding both release and detention for certain offenses and specifies circumstances in which these presumptions apply. Requires the judicial council to appoint a committee to review and recommend changes to the Hawaii penal code.

Provides development guidance policies for the stadium authority. Tasks the authority with seeking to promote the safety and reliability of harbor infrastructure by identifying and developing appropriate areas within the stadium development district, including stadium parking lots as appropriate, that are fortified to withstand the structural requirements of a permanent shipping container storage and lay down facility for emergency use by Pearl Harbor.

Reduces from 500 feet to 100 feet the buffer zones for commercial hemp production and processing. Authorizes hemp to be grown at a residential property under the control of a person licensed under federal law to produce hemp. Repeals authorization from the state department of agriculture as a prerequisite to transport hemp. Authorizes commercial hemp producers to sell whole, unprocessed hemp leaves to consumers, subject to certain requirements. Requires labels that disclose that leaves and hemp products were from hemp grown in the State. Replaces the referenced testing standard authority on labels for hemp products.

Requires that the Hawaiian version of a law be held binding if the law in question was originally drafted in Hawaiian and then translated into English.

Requires persons applying for a commercial marine license to appear in person before DLNR. Prohibits DLNR from issuing or renewing a commercial marine license to an alien crew member who has not been granted permission to land temporarily by federal law. Requires a DLNR permit for black coral taken within the jurisdiction of the State for commercial purposes.
