RELATING TO MICROENTERPRISE HOME KITCHENS.

Authorizes microenterprise home kitchens to prepare and sell food directly to consumers without food establishment permits or routine inspections, subject to consumer disclosure and basic food safety requirements. Clarifies that microenterprise home kitchens are not food establishments or food processing establishments. Authorizes the Department of Health to conduct investigations on operators and microenterprise home kitchens in response to complaints, foodborne illness outbreaks, and imminent threats to public health. Effective 7/1/3000. (HD1)

RELATING TO SPORTS OFFICIALS.

Authorizes the Department of Education to retain private counsel to represent a sports official in certain civil proceedings to obtain a temporary restraining order in response to incidences where the sports official has been assaulted or threatened in the course of legally discharging their sports official duties. Includes substantial bodily injury of a sports official engaged in the lawful discharge of the sports official's duties in the offense of assault in the first degree. Clarifies that a sports official includes a school administrator, league administrator, or athletics director. Clarifies that a sports official's duties cover sports events at public schools and private schools. Effective 7/1/3000. (HD1)

RELATING TO PEDESTRIAN SAFETY.

Clarifies driver's obligations at crosswalks. Requires drivers to stop and remain stopped for pedestrians in crosswalks. Strengthens penalties for traffic violations, particularly in school zones. Creates additional criminal penalties when pedestrians suffer bodily injury. Provides heightened protections for blind and visually impaired pedestrians. Effective 7/1/3000. (HD1)

RELATING TO MEDICAID.

Repeals a provision in Act 4, Special Session Laws of Hawaii 2005, that prohibits the Department of Human Services from taking any action to remove pharmaceutical benefits management from managed care plans that provide health care coverage for Hawaii Medicaid beneficiaries. Effective 7/1/3000. (HD1)

RELATING TO COMMUNITY CARE FOSTER FAMILY HOMES.

Clarifies that individuals with intellectual and developmental disabilities who meet an intermediate care facility or nursing facility level of care shall not be denied residency in a licensed community care foster family home solely because of their disability or enrollment in a specific medicaid waiver program. RELATING TO LABOR.

Clarifies the employment status of certain delivery drivers under state laws related to workers' compensation, wage and hour, temporary disability insurance, family leave, tax classification of business relationships, and unemployment insurance by establishing conditions under which delivery drivers are deemed employees of the business operating the delivery program. RELATING TO TAXATION OF ADVERTISING REVENUE BY MAJOR SOCIAL MEDIA PLATFORMS.

Establishes the Broadband and Digital Equity Special Fund to receive revenues earned by major social media platforms to fund initiatives expanding broadband access and local journalism initiatives. Directs the Department of Taxation to apply the state corporate income tax to advertising revenue earned by major social media platforms if the revenue is derived from content created within the State or from audiences located in the State. Appropriates funds. Effective 7/1/3000. (HD1)

RELATING TO STUDENT HEALTH.

Authorizes a school to maintain a stock supply of over-the-counter oral antihistamines to be administered under certain conditions. Authorizes school personnel to administer the over-the-counter oral antihistamine medication, under certain conditions.

RELATING TO ENERGY.

Prohibits the Public Utilities Commission from approving costs of infrastructure, operations and maintenance, fuel, or other costs relating to supplying and using liquefied natural gas unless certain conditions are met. Requires the Public Utilities Commission to consider the effect of fossil fuels on renewable energy, stranded investment risks and costs, and costs and risks of reliance on a single fuel supply or monopoly supplier when making determinations of the reasonableness of the costs pertaining to electric or gas utility system capital improvements and operations. Effective 7/1/3000. (HD1)
