RELATING TO THE TRANSFER OF NON-AGRICULTURAL PARK LANDS.

Exempts easements granted over public lands affecting the transfer of public lands between DLNR and DOA from formal county subdivision process and approval requirements. Requires the DOA to accept the transfer of and manage certain qualifying non-agricultural park lands. Requires the DOA, prior to offering a lease, to inquire with the DLNR regarding any easements required for access to landlocked forest reserves or other assets on the lands subject to the lease. Requires the lessee to develop a conservation program and plan if conservation resources exist on the land. Before the transfer of non-agricultural park lands, authorizes the DOA to request information from the DLNR related to the establishment of necessary and reasonable easements upon the lands. Requires approval from the board of land and natural resources and the board of agriculture before removing pasture lands for reforestation, or other public purposes.

RELATING TO THE SEEKING OF ASSISTANCE.

Provides protections to individuals involved in the sex trade from the consequences under criminal law of disclosing their engagement or being identified as engaging in prostitution while in the course of seeking medical or law enforcement assistance.

RELATING TO CAPITAL GAINS.

Increases the capital gains tax threshold from 7.25 per cent to 9 per cent. Increases the alternative capital gains tax for corporations from 4 per cent to 5 per cent. Applies to tax years beginning after 12/31/2022. Effective 6/30/3000. (HD1)

RELATING TO HEALTH.

Repeals existing law that requires the Department of Health to conduct unannounced visits and inspections, including inspections for relicensing or recertification, of state-licensed special treatment facilities. Requires the Department of Health to prioritize investigations of complaints against state-licensed or state-certified care facilities based on the degree of severity of the allegations. Clarifies that any person, corporation, or any other entity that provides health care or human services is prohibited from knowingly referring or transferring patients to an uncertified or unlicensed care facility. Repeals existing law providing that a landlord shall not be deemed to be providing home care services or operating a care facility that requires a license under specified conditions. RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM.

Provides police officers who become members of the ERS after 6/30/2023 with retirement benefits similar to those provided for members of the ERS who became members before 7/1/2012, including but not limited to calculation of retirement allowance, minimum age or years of credited service requirements, and vesting period. Allows retired police officers hired after 6/30/01 to be treated as if employment began before 7/1/01 in order to maintain spousal health benefits.

RELATING TO THE STATE ARCHIVES.

Expands the uses for the state archives preservation and long-term access special fund from the preservation of and long-term access to government records only, to include photographic, phonographic, and audio-video records and collections that have a unique historical value or are related to Hawaiʻi's diverse ethnic and indigenous cultures. Establishes additional funding sources for, and authorizes additional expenditures of moneys from, the state archives preservation and long-term access special fund. Appropriates moneys. RELATING TO SERVICE ANIMALS.

Requires that a written disclaimer be provided by sellers or providers of emotional support animals or certificates or identification tags for emotional support animals that the animal is not a service animal or the item does not qualify as an item for a service animal.
