RELATING TO THE HAWAII ABLE SAVINGS PROGRAM.

Repeals language that gives the director of finance discretion to use moneys in the Hawaiʻi ABLE savings program trust fund if the director elects to accept deposits from contributors instead of sending deposits directly to the ABLE program manager. Authorizes the director of finance to expend moneys in the Hawaiʻi ABLE savings program trust fund to provide incentive payments to Hawaiʻi public school ABLE account owners. Appropriates moneys to fund incentive payments. Establishes and appropriates moneys to fund one full-time equivalent (1.0 FTE) permanent position to provide statewide outreach, advocacy, and relationship management for the Hawaiʻi ABLE savings program. RELATING TO CESSPOOLS.

Part I: Establishes and appropriates funds for a county cesspool pilot program in the Department of Health to work with each county to identify a priority area to expand the county sewage system or other centralized treatment system to connect individual properties in the priority area and reduce or eliminate cesspools in the identified area. Part II: Creates a cesspool conversion section in the Department of Health to facilitate the conversion of cesspools within the State. Establishes and appropriates funds for positions. Part III: Requires the Department of Health to retain qualified consultants to identify necessary public outreach and education resources and tools, and develop a comprehensive public outreach strategy and educate homeowners regarding the State's cesspool upgrade, conversion, and connection requirements and deadlines. Part IV: Establishes, for all taxable years after December 31, 2023, an income tax credit for the cost of upgrading or converting a qualified cesspool to a Director of Health-approved wastewater system or connecting to a sewerage system. Requires that, effective 11/1/23, certain information regarding cesspools on real property be included in seller mandatory disclosures for real property transactions. Effective 6/30/3000. (SD2)

RELATING TO HISTORIC PRESERVATION REVIEWS.

Allows the Department of Hawaiian Home Lands to assume historic preservation review of any proposed project for lands under its jurisdiction except for projects affecting properties listed or nominated for inclusion in the Hawaiʻi register of historic places or the national register of historic places. Establishes certain written notice requirements for the Department of Hawaiian Home Lands. Takes effect 7/1/2050. (SD1)

RELATING TO ADMINISTRATIVE FEES.

Statutorily establishes a Department of Land and Natural Resources transaction fee for each recording in the Bureau of Conveyances and Land Court. Amends the authorized uses of moneys in the Bureau of Conveyances Special Fund. Repeals language that required the Bureau of Conveyances' microfilm fees to be established by rules. RELATING TO SCHOOL SAFETY.

Requires the Department of Education to create emergency access plans for each Department school. Requires each Department school to have a comprehensive school evacuation communication plan for use during emergencies. Requires the Department of Education to collaborate with the Department of Transportation to assess all Department school campuses to determine if there are sufficient emergency evacuation routes for each campus and report to the Legislature. RELATING TO ELECTRIC VEHICLE CHARGING INFRASTRUCTURE.

Requires the design of all new state building construction where parking is to be included to provide that at least twenty-five per cent of parking stalls be electric vehicle charger-ready. Requires the Hawaiʻi State Energy Office, in consultation with the Department of Accounting and General Services, to conduct a survey and identify certain high-priority state facilities. Establishes a goal of the State to retrofit state facilities to be electric vehicle charger-ready. Requires a report to the Legislature. RELATING TO SEARCH AND RESCUE.

Repeals the existing conditions under which government entities may seek reimbursement for search or rescue expenses and instead requires a government entity of the State to impose and collect a fee for search or rescue expenses for persons who require rescue after leaving a hiking trail to enter an area closed to the public or hiking on a trail closed to the public, with a sign giving notice of the closure. Requires a report or documentation of the search and rescue to be submitted to the Department of the Attorney General. Takes effect 7/1/2042. (SD1)
