Transfers the administrative attachment of the Hawaii correctional system oversight commission from the department of the attorney general to the department of human services.

Clarifies that the department of public safety retains custody of and jurisdiction over any Hawaii inmate who has been transferred to and is incarcerated at a correctional institution located outside of the State. Provides that the department of public safety may transfer any Hawaii inmate who was transferred to an out-of-state institution back to the State at any time and for any reason. Requires Hawaii inmates incarcerated outside of the State to be afforded all rights and privileges available to inmates incarcerated at correctional institutions located within the State. The purpose of this Act is to require transfer of nonfacility general fund per-pupil allocations of special education students of a department of education school to a charter school upon receipt of the completed intent to enroll form of the student at the charter school subject to certain conditions, including parent or guardian confirmation and notice of intent of the student's transfer to and enrollment in the charter school.
Establishes a moratorium on the construction of any new correctional facilities in the State from 7/1/2021 to 6/30/2022, including the planned construction of a new facility to replace the existing Oahu community correctional center. Prohibits the construction of new correctional facilities or the expansion of existing correctional facilities without the department of public safety first obtaining the input of and recommendations from the Hawaii correctional system oversight commission on any master plan for the facility, and the inclusion of the commission's input and recommendations in any environmental impact statement for the project. Establishes the offense of a loaded firearm while intoxicated as a petty misdemeanor.
Requires the Hawaii correctional oversight commission to create a comprehensive plan to phase out the use of private correctional institutions by 2025. Prohibits the construction of new correctional facilities and the expansion of existing correctional facilities without first obtaining input and recommendations of the Hawaii correctional system oversight commission. Eliminates the use of monetary bail, with certain exceptions, and requires defendants to be released on their own recognizance for traffic offenses, violations, non-violent petty misdemeanor offenses, and non-violent misdemeanor offenses. Creates a rebuttable presumption regarding both release and detention for certain offenses and specifies circumstances in which these presumptions apply. Requires the judicial council to appoint a committee to review and recommend changes to the Hawaii penal code.
Proposes a constitutional amendment that guarantees individuals the right to a clean and healthy environment, including pure water, clean air, healthy ecosystems, and a stable climate, and to the preservation of the natural, cultural, scenic and healthful qualities of the environment. Clarifies that the rights guaranteed may not be diminished by Article XI, Section 9, of the State Constitution. Effective 7/1/2050. (HD1)
Establishes a remote work transition grant program within DBEDT to assist businesses in converting to virtual offices or building remote work capabilities. Appropriates funds.
Clarifies that when trespass involves public land, all law enforcement officers shall enforce trespass laws, without regard to whether the land is owned by the State or by a county.
