Permits charitable organizations to hold online fundraising events, including online raffles. Excludes online fundraising by charitable organizations from the definition of "gambling" in the Hawaii penal code.
Defines "pre-contact historic property". Clarifies that the historic preservation program includes the development, publication, and distribution of materials about protections for burials, historic sites, and archaeological resources. Increases civil and administrative fines for certain violations of historic and preservation requirements and makes violators liable for costs associated with mitigation or restoration measures. Proposes an amendment to the Hawaii State Constitution to repeal the exclusive power of the counties as to the functions, powers, and duties relating to the taxation of real property and authorize the State to also exercise those functions, powers, and duties. Effective 7/1/2050. (HD1)
By 1/1/2026, requires the department of taxation to suspend and refund certain income tax amounts received or withheld upon the enactment of a state law specifying real property tax amounts. Takes effect upon the ratification of a constitutional amendment authorizing the State to have additional real property taxing authority. Effective 7/1/2050. (HD1)
Requires the University of Hawaii to include in certain employment agreements that address intellectual property rights a condition requiring the employees to make a good faith effort to sell or license intellectual property to a farmer or agricultural producer within the State prior to selling or licensing the intellectual property to an entity outside the State. Requires the legislative reference bureau to conduct a study on telework and the use of alternative work schedules for state employees. Requires state departments and agencies to cooperate with the legislative reference bureau. Requires the legislative reference bureau to submit a report of its findings and recommendations, including proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2022. Ensures the collection of the state general excise tax in instances in which the transportation of passengers is furnished by common carriers by the use of aircraft when the collection of the tax is not prohibited by federal law. Limits imposition of tax to flights that occur within the airspace of a single island of the State.
Restricts civil asset forfeiture to cases involving the commission of a felony offense where the property owner has been convicted of an underlying felony offense. Directs any forfeiture proceeds to the general fund.
Authorizes medical cannabis dispensaries to distribute cannabis propagules and cuttings to individuals authorized to cultivate cannabis plants for medical use, subject to quantity limits and quality requirements.
