RELATING TO FACE COVERINGS.

Requires every person to wear a face covering when in a public setting, subject to certain exceptions. Establishes a civil fine for failure to wear a face covering. Sunsets December 31, 2021, or when the last emergency proclamation related to the COVID-19 emergency issued by the governor expires, whichever is sooner. Effective 7/1/2050. (HD2)

RELATING TO SEXUAL ASSAULT.

Amends the offenses of sexual assault in the first and third degree perpetrated against a person who is mentally defective to provide that a perpetrator commits the offense if the perpetrator is negligent in not knowing of the mental defect of the victim. (CD1)

RELATING TO THE BOILER AND ELEVATOR SAFETY LAW.

Authorizes the Director of Labor and Industrial Relations to prohibit the operation of pressure retaining items, amusement rides, and elevators and kindred equipment if inspection fees or fines are not timely paid. Deletes the statutory boiler and elevator fee schedule and requires the director to establish the fees by rules adopted pursuant to chapter 91, Hawaii Revised Statutes. Defines "amusement ride", "permit to operate", and "pressure retaining item". Replaces "boiler, pressure systems" with "pressure retaining items" throughout chapter 397, Hawaii Revised Statutes. RELATING TO ACCESS TO LEARNING.

Authorizes the department of education to directly accept private funding for the purpose of establishing public prekindergarten programs under certain circumstances. Establishes the Hawaii early childhood educator stipend program to address shortage of early childhood education educators. Establishes the Hawaii early childhood educator special fund. Extends certain effective dates for implementation of Act 46, SLH 2020. Requires the application of a uniform assessment for public and charter school kindergarten students. Allows educational data to be shared using an existing system. Appropriates funds. Repeals and abolishes the Hawaii early childhood educator special fund on 6/30/2023. (CD1)

RELATING TO CERTAIN PENALTIES FOR VIOLATIONS OF SUBTITLE 4 OF TITLE 12, HAWAII REVISED STATUTES.

Amends the additional fines and costs for destroying or harvesting trees or tree products, including koa, on state forest reserves lands. Establishes penalties for any person who violates vehicular parking or traffic movement rules adopted by the DLNR under forest reserves, water development, and zoning laws. Authorizes the State to pursue civil legal action and criminal action against a person violating forest reserves, water development, and zoning laws and rules. Establishes criminal penalties for violations of all forest reserves laws or rules. Repeals the general penalty provision for violations of certain forestry and wildlife, recreation areas, and fire protection laws and rules. (SD1)

RELATING TO ELECTRIC GUNS.

Regulates the sale and use of electric guns and cartridges. Repeals the prohibition on the possession, sale, offer for sale, give, lend, or delivery of any electric gun. Effective 1/1/2022. (CD1)

RELATING TO THE UNIFORM CONTROLLED SUBSTANCES ACT.

Updates the Uniform Controlled Substances Act, chapter 329, Hawaii Revised Statutes, to make it consistent with amendments in the federal controlled substances law as required by section 329-11, Hawaii Revised Statutes. (HD1)

RELATING TO SUSTAINABLE AVIATION FUEL.

Establishes the sustainable aviation fuel program to provide matching grants to any small business in Hawaii that is developing products related to sustainable aviation fuel or greenhouse gas reduction from commercial aviation operations. (CD1)
