RELATING TO NOISE CONTROL.

Enhances the control of low-frequency noise emitted from establishments regulated by county liquor commissions by setting a maximum permissible noise level in dBC measurements. Clarifies that emission of noise that exceeds the maximum permissible noise level constitutes a noise violation. Allows noise violations to be enforced by summons or citation issued by law enforcement officers. Allows county liquor commissions to adopt rules to issue fines for noise violation. Allows county liquor commissions to revoke or suspend a liquor license, deny the application, renewal, or transfer of a license, or withhold issuance of a license when the licensee or applicant fails to take corrective action to address noise complaints or violations.

RELATING TO LIQUOR LICENSES.

Increases the maximum allowable fine for violation of liquor control laws by a licensee from $2,000 to $5,000.

RELATING TO LAW ENFORCEMENT.

Prohibits the issuance of warrants, including no-knock warrants, that permit entry by an officer to a house, store, or other building without first audibly declaring the officer's office and business. Requires law enforcement officers serving an arrest warrant at a house or a search warrant at a house, store, or other building to audibly declare the officer's office and business and wait at least thirty seconds for compliance before entry. Requires officers serving a warrant to do so while wearing an authorized uniform and activated body-worn video camera.

RELATING TO CONTRACTORS.

Requires DCCA to maintain and make public a list of persons that performed work without the required contractor license. Requires that certain documents be submitted to DCCA for projects being conducted pursuant to the owner-builder exemption of the contractor licensing law. Establishes fees based on the estimated value of the work to be performed by the owner-builder, to be used to pay for county building inspections. Requires owner-builders to provide written permission for a county to enter the property for inspection prior to a county issuing a building permit.

RELATING TO VICTIM-COUNSELOR PRIVILEGE.

Expands the victim-counselor privilege under Rule 505.5 of the Hawaii Rules of Evidence to include victims of dating violence, stalking, and sexual harassment and confidential advocates employed by the University of Hawaii. Effective 7/1/2060. (HD2)

RELATING TO CORRECTIONAL FACILITIES.

Establishes a moratorium on the construction of any new correctional facilities in the State from 7/1/2021 to 6/30/2022, including the planned construction of a new facility to replace the existing Oahu community correctional center. Prohibits the construction of new correctional facilities or the expansion of existing correctional facilities without the department of public safety first obtaining the input of and recommendations from the Hawaii correctional system oversight commission on any master plan for the facility, and the inclusion of the commission's input and recommendations in any environmental impact statement for the project. Effective 7/1/3050. (HD1)

RELATING TO TAXATION OF REAL ESTATE INVESTMENT TRUSTS.

Disallows dividends paid deduction for real estate investment trusts. Specifies that amounts collected from the disallowance be evenly divided and deposited into the dwelling unit revolving fund and rental housing revolving fund. Applies to taxable years beginning after 12/31/2021. Sunsets 12/31/2024.
